McLean Mortgage Corporation agreed to a settlement over an October 2024 cyberattack that may have exposed names, Social Security numbers, driver's license numbers, financial account numbers, passport numbers, and health insurance information. Class members can claim three years of credit monitoring plus either a flat $45 cash payment or reimbursement of documented losses of up to $1,000 for ordinary expenses and up to $4,000 for identity theft or fraud. What happened

The lawsuit concerns a targeted cyberattack on McLean Mortgage Corporation's computer systems on or around October 17, 2024. According to the settlement website, files that may have been compromised contained names, Social Security numbers, driver's license numbers, financial account numbers, passport numbers, health insurance information, and other personally identifiable information. Plaintiffs allege that McLean failed to adequately protect this information.

McLean denies any wrongdoing and denies that the plaintiffs suffered any damages, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. This is a claims-made settlement, so there is no fixed common fund. McLean pays each valid claim at the set benefit amounts, and separately pays attorneys' fees and costs and service awards approved by the Court.

How to file a claim

  • 1. Confirm you are eligible

    You qualify if you are a living U.S. resident whose personal information was potentially compromised in the McLean Data Incident on or around October 17, 2024, including anyone who was sent a notice letter. If you are unsure, call the Settlement Administrator at (833) 200-6767.

  • 2. Choose your benefits

    Every class member can claim three years of CyEx Financial Shield Complete one-bureau credit monitoring with $1 million in fraud insurance. For cash, you can claim reimbursement for documented ordinary losses of up to $1,000, documented extraordinary losses from identity theft or fraud of up to $4,000, and lost time of up to $100 (up to 4 hours at $25 per hour, with a sworn statement). Losses must have been incurred between October 17, 2024 and December 10, 2026. Instead of any other cash payment, you may choose a one-time Alternative Cash Payment of $45 with no documentation required.

  • 3. File online or by mail

    Submit your claim online at the official claim portal by December 10, 2026, or mail a paper Claim Form postmarked by that date to In re McLean Data Breach Litigation, c/o Simpluris, Inc., P.O. Box 25226, Santa Ana, CA 92799-9958. The online form requires the LoginID and PIN printed on your notice. If you cannot find them, email info@McLeanDataSettlement.com with your full name and mailing address. Documented loss claims require supporting documentation. The Settlement Agreement and notice are posted at McLeanDataSettlement.com.

  • 4. Receive your benefits

    Payments are distributed after the Court grants final approval at the December 10, 2026 Final Approval Hearing and after any appeals are resolved. Credit monitoring enrollment instructions are provided to claimants who select that benefit.

The Final Approval Hearing is scheduled for December 10, 2026 at 11:00 a.m. ET in Room 6100 of the U.S. District Court for the Eastern District of Virginia, Richmond Division. The Court will also consider Class Counsel's request for attorneys' fees, costs, and service awards, which McLean pays separately from class member benefits. Opt-out requests and objections must be submitted by November 10, 2026. Note that the claim deadline falls on the same day as the hearing. The Court may move the hearing, so check McLeanDataSettlement.com for updates before traveling.

Where the money is going

This is a claims-made settlement with no fixed settlement fund. Rather than dividing a pool among claimants, McLean pays each valid claim at the set benefit amounts below. Attorneys' fees and costs and service awards are paid by McLean separately and do not reduce class member benefits. Roughly 30,453 people were reportedly affected by the Data Incident.

All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. Reimbursement amounts are caps, not guarantees, and depend on the documentation you submit and the Settlement Administrator's review.

Common questions

How much money will I receive?

You can claim three years of credit monitoring plus either a flat $45 Alternative Cash Payment or reimbursement of documented losses: up to $1,000 for ordinary losses, up to $4,000 for identity theft or fraud losses, and up to $100 for lost time. These are maximums, not guaranteed amounts, and depend on what you document.

Do I need to submit proof of purchase?

The $45 Alternative Cash Payment does not require documentation, but you still need to submit a valid Claim Form. Ordinary and extraordinary loss reimbursements require supporting documentation, and lost time requires a sworn statement. The online form requires the LoginID and PIN from your notice.

What if I didn’t receive a notice?

The class includes all living U.S. residents whose information was potentially compromised in the Data Incident, not only people who received a letter. Filing online requires the LoginID and PIN printed on the notice. If you did not receive one, email info@McLeanDataSettlement.com with your full name and mailing address or call (833) 200-6767 before the December 10, 2026 deadline.

Does staying in the class affect my right to sue later?

If you stay in the settlement, you give up the legal claims against McLean described in Section VI of the Settlement Agreement relating to the Data Incident, whether or not you file a claim. To keep those rights, you must opt out by November 10, 2026.

When will payments be sent out?

Payments are distributed after the Court grants final approval at the December 10, 2026 Final Approval Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
