What happened

Plaintiffs Jonathan Beer and Thalia Calo Gonzalez filed a class action against Fandango Media, LLC in the Superior Court of California, County of San Diego (Case No. 25CU046749N). The lawsuit raises two claims. First, it alleges that Fandango failed to timely disclose a mandatory Convenience Fee when consumers purchased movie tickets online to California theaters between June 11, 2020 and June 17, 2024, in violation of California law. Second, it alleges that Fandango violated certain laws in connection with its FanClub membership program, which offered $10.00 monthly credits, discounts, or promo codes that expired after 30 days, sold to California and Washington consumers between October 7, 2024 and April 16, 2025.

Fandango denies that it violated any law and maintains that its disclosures and practices were lawful at all times. The parties agreed to the settlement to avoid the uncertainties and expenses of continued litigation. The estimated total value of cash benefits and vouchers to be distributed is approximately $9.4 million. Attorneys' fees, administration costs, and service awards are paid separately by Fandango and do not reduce the benefits that class members receive.

Common questions

What will I receive?

It depends on which class you belong to. Convenience Fee Class members who file a claim receive $3.25 in cash (check or electronic payment). If you don't file a claim, you automatically get a $3.25 Fandango voucher instead (expires 3 years after issuance). FanClub Class members automatically receive a $7.50 Fandango voucher with no expiration. If you are in both classes, you get benefits from each.

Do I need to file a claim?

Only if you are in the Convenience Fee Class and want cash instead of a voucher. File a Claim Form by August 17, 2026 to get the $3.25 cash payment. If you do nothing, you still receive a $3.25 voucher. FanClub Class members do not need to file any claim and will automatically receive their $7.50 voucher.

I did not receive a Notice ID. How do I file?

You will need the unique Notice ID and confirmation code from the email notice Fandango sent you. If you did not receive it but believe you are a class member, call the Settlement Administrator at (877) 279-8792 to verify your identity and get instructions on how to file.

How can I use the voucher?

Vouchers can be applied toward movie ticket purchases at Fandango.com or the Fandango app, including any applicable taxes. Vouchers cannot be redeemed at a theater box office, cannot be combined with other discounts or offers, and are not transferable. If your voucher exceeds the order total, the unused portion carries over to future purchases.

When will I get my payment or voucher?

The Court will hold a Final Approval Hearing on August 7, 2026. If approved with no appeals, benefits will be distributed afterward. If there are appeals, it could take longer, possibly more than a year. Check fandangomediasettlement.com for updates on timing.
