Grubhub Holdings Inc. agreed to a $24.75 million settlement to resolve a class action alleging that the company misclassified California delivery drivers as independent contractors in violation of California labor law. Eligible class members who submit a claim will receive a payment based on their estimated miles driven while delivering through the Grubhub app, with a guaranteed minimum of $25.

Do you qualify?
You may qualify if ALL of the following apply:
- You entered into an agreement with Grubhub to use the Grubhub platform as an independent contractor to offer delivery services
- You accepted or completed at least one (1) delivery in California between December 3, 2014 and March 13, 2026
- You submit a valid Claim Form online or by mail by June 18, 2026 (you must file a claim to receive payment)
- No payment if you do nothing: Unlike some settlements, you must submit a claim to receive money. If you do nothing, you remain in the class and release your claims but receive no payment.

What happened
In September 2015, Plaintiff Raef Lawson filed a complaint in San Francisco County Superior Court alleging that Grubhub misclassified its California delivery drivers as independent contractors. The case was removed to the U.S. District Court for the Northern District of California (Case No. 15-cv-05128 JSC). The lawsuit claims Grubhub violated California labor law by failing to reimburse delivery drivers for necessary business expenses, failing to pay minimum wages and overtime, and not meeting the conditions necessary for Proposition 22 to apply. In January 2026, the complaint was amended to add Rejenna Marshall as a plaintiff.
During litigation, the Court found that Plaintiff Lawson had been misclassified by Grubhub for purposes of his minimum wage and overtime claims and that he experienced minimum wage violations. Grubhub denies all allegations and denies that delivery drivers were or are employees. After ten years of litigation and five formal mediation conferences, the parties agreed to a $24.75 million settlement that they believe is a fair, reasonable, and adequate compromise. Each class member's share will be calculated based on estimated miles driven while using the Grubhub app.

Confirm your eligibility
You must have used the Grubhub platform as an independent contractor delivery driver and completed at least one delivery in California between December 3, 2014 and March 13, 2026. Grubhub's records are used to identify eligible class members.

Submit your claim online
File your claim at grubhubcalsettlement.com/form/claim. You must file by June 18, 2026. If you do not submit a claim, you will not receive a payment.

Receive your payment
Payments will be mailed approximately 30 days after the settlement becomes final. Your share is calculated based on your estimated miles driven while using the Grubhub app, with a minimum payment of $25. Settlement checks expire 180 days after issuance. If your address changes, notify the Claims Administrator immediately.

Where your money goes
Individual payments are calculated proportionally based on estimated miles driven while using the Grubhub app. No class member who submits a valid claim will receive less than $25.
All amounts listed above are pending and subject to final court approval at the fairness hearing.
Common questions
How much will I receive?
Your payment is based on the estimated number of miles you drove while delivering through the Grubhub app between December 3, 2014 and March 13, 2026. The Claims Administrator will review Grubhub's records to calculate your share. No valid claimant will receive less than $25. The exact amount cannot be determined until the Court approves the settlement and deductions for attorneys' fees, administration costs, PAGA penalties, and service awards are made.
Do I need proof of my deliveries?
No. Grubhub's own records will be used to identify eligible class members and calculate estimated miles driven. You do not need to provide documentation of your deliveries. You simply need to submit a valid Claim Form by the deadline.
What if I never received a notice about this settlement?
If you believe you qualify as a class member but did not receive a notice, you can still submit a claim by the June 18, 2026 deadline. What rights do I give up by staying in the settlement?
By remaining in the class, you release claims related to misclassification as an independent contractor during the class period, including claims for unpaid wages, overtime, expense reimbursement, meal and rest breaks, PAGA penalties, and related California labor law violations. If you submit a claim, you also release FLSA claims. You do not release claims for retaliation, wrongful termination, unemployment, disability, or workers' compensation. To preserve your right to sue Grubhub individually, you must opt out by June 18, 2026.
When will payments be sent out?
The Court is scheduled to hold a Final Approval Hearing on July 30, 2026 via Zoom. If approved with no objections or appeals, payments will be mailed within a couple of months after the hearing. If there are appeals, it could take longer, possibly more than a year. Settlement checks are void 180 days after issuance, and unclaimed funds will be directed to Legal Aid at Work.
