FitOn, Inc. agreed to a $2.5 million settlement over allegations that it disclosed subscribers' personally identifiable information, including their video-viewing activity, to third parties without consent, in violation of the Video Privacy Protection Act (VPPA). Anyone in the U.S. who had a FitOn account and watched or acquired a pre-recorded video on a FitOn Video Platform between October 22, 2022 and May 29, 2026 can file a claim for a $10.00 cash payment, subject to pro rata reduction.

What happened

Plaintiffs Ava Hoffman, Shante Pierro, and Daniela Zamor allege that FitOn, Inc. disclosed its subscribers' personally identifiable information (PII), including data identifying which specific videos they watched, to third parties without consent. Plaintiffs claim this conduct violated the Video Privacy Protection Act (VPPA), 18 U.S.C. § 2710, which protects consumers from having their video-viewing histories shared without permission.

FitOn denies the allegations and denies that it violated any law. The parties agreed to settle to avoid the cost, risk, and uncertainty of continued litigation.

How to file a claim

  • 1. Confirm you are eligible

    You must have had a FitOn account and accessed a FitOn Video Platform to watch or acquire a pre-recorded video between October 22, 2022 and May 29, 2026.

  • 2. Tally up your claim

    No documentation is required. Each valid claimant receives a $10.00 cash payment, subject to pro rata reduction if Approved Claims exceed the $2,500,000 Net Settlement Benefit Cap.

  • 3. File online or by mail

    Submit the Claim Form online at fitonvppasettlement.com/form/claim by August 31, 2026, or mail a printable Claim Form to the Settlement Administrator at: FitOn VPPA Settlement, P.O. Box 25191, Santa Ana, CA 92799-5598.

  • 4. Receive your payment

    Payments are issued after the Court grants final approval at the October 6, 2026 Final Approval Hearing and any appeals are resolved. The appeal process can take a year or more. Payment will be by check, PayPal, or Venmo; checks expire 180 days after issuance.

The Final Approval Hearing is scheduled for October 6, 2026 at 11:00 a.m. ET before the Honorable Saul Stein in the New York Supreme Court for Kings County. The Court may move the hearing, so check FitOnVPPASettlement.com for updates before traveling.

Where the money is going

This is a non-reversionary common fund. Attorneys' fees, service awards, and notice and administration costs come out of the $2,500,000 before payments are calculated for class members.

Common questions

How much money will I receive?

Each valid claimant receives a $10.00 cash payment, subject to pro rata (equal) reduction if Approved Claims for Cash Payments exceed the $2,500,000 Net Settlement Benefit Cap. The exact per-person amount depends on how many valid claims are filed.

Do I need to submit proof of purchase?

No documentation is required. You just need to submit a Claim Form confirming you had a FitOn account and accessed a FitOn Video Platform to watch or acquire a pre-recorded video between October 22, 2022 and May 29, 2026.

What if I didn’t receive a notice?

You can still file a claim even if you did not receive a notice. Notice was distributed based on FitOn's account records, but you are eligible as long as you meet the class definition. File online at FitOnVPPASettlement.com or contact the Settlement Administrator.

Does staying in the class affect my right to sue later?

By staying in the Settlement Class (that is, by not excluding yourself), you release all claims that were or could have been brought against FitOn arising from the same allegations, including VPPA claims, regardless of whether you file a claim. To preserve your right to sue FitOn over these issues, you must exclude yourself in writing by August 31, 2026.

When will payments be sent out?

Payments are expected after the October 6, 2026 Final Approval Hearing and after any appeals are resolved. This process can take a few months, or longer if there is an appeal.
