Duke University Health System, Inc. agreed to a $3,743,600 class action settlement over allegations that tracking pixels embedded on its patient-facing website may have disclosed patients' personal and health-related information to a third-party vendor without authorization. Do you qualify?
You are a Class Member if ALL of the following apply:
- You reside in the United States.
- You logged into the Duke MyChart patient portal or the MyDuke Health mobile app at least once between February 18, 2019, and June 17, 2022.
- Duke Health's records identify you as a Class Member. If you received a notice by mail or email from the Settlement Administrator, you have already been identified.
- Excluded: Duke University Health System, Inc. and its affiliates, parents, subsidiaries, officers, and directors; any judge, justice, or judicial officer presiding over the litigation, their immediate family members, and clerks; and anyone who timely and validly excludes themselves from the Settlement.

What happened
The lawsuit alleges that Duke Health used third-party tracking technologies, including a piece of code known as a "pixel," on its patient-facing website and patient portal. Plaintiff alleges that these tools caused web usage data containing patients' personal and health-related information to be shared with a third-party vendor, constituting an invasion of privacy. The alleged disclosure is said to have occurred between February 18, 2019, and June 17, 2022.
Duke Health denies all claims and all allegations of wrongdoing or liability, and the Court has not determined that Duke Health did anything wrong. The parties agreed to settle to avoid the cost, risk, and uncertainty of continued litigation. No changes to Duke Health's practices are required under the Settlement terms.
How to file a claim

1. Confirm you are eligible
You must reside in the United States and have logged into the Duke MyChart patient portal or the MyDuke Health mobile app at least once between February 18, 2019, and June 17, 2022. If you received a direct notice from Epiq by mail or email, you have already been identified as a potential Class Member.

2. Review your claim
Eligible Class Members share pro rata in the Net Settlement Fund. No receipts, account numbers, or other documentation are required. There is one claim per Class Member. The per-person amount depends on the total number of valid claims filed; the more claimants who participate, the smaller each individual share.

3. File online or by mail
Submit the Claim Form online at DUHSSettlement.com/Login by August 16, 2026, or mail a paper Claim Form (postmarked by August 16, 2026) to: Williams v. Duke University Health System, Inc., Settlement Administrator, P.O. Box 4214, Portland, OR 97208-4214.

4. Receive your payment
Payments are issued after the Court grants final approval at the August 27, 2026 Final Approval Hearing and any appeals are resolved. The appeal process can take a year or more. No follow-up is required once your Claim Form is submitted.

Where the money is going
This is a non-reversionary common fund. Attorneys' fees, the Class Representative service award, and notice and administration costs are paid from the $3,743,600 Settlement Fund before distributions to Class Members are calculated.
All deductions are subject to final court approval at the August 27, 2026 Fairness Hearing. The Court may award less than the amounts requested. Each eligible Class Member who submits a valid and timely claim receives an equal pro rata share of whatever remains after deductions.
Common questions
How much money will I receive?
Class Members who submit a valid and timely Claim Form receive an equal pro rata share of the Net Settlement Fund. The exact amount per person is not fixed in advance; it depends on how many valid claims are filed. No receipts, account numbers, or other documentation are required to file. There is a limit of one claim per Class Member.
Do I need to submit proof of purchase?
No documentation is required. You do not need receipts, account records, or any other proof to file a claim. Simply submit the Claim Form confirming you meet the eligibility criteria. The Settlement Administrator, Epiq, has records identifying Class Members and will validate your claim against Duke Health's records.
What if I didn’t receive a notice?
You can still file a Claim Form if you did not receive a direct notice, so long as you meet the eligibility criteria (U.S. resident who logged into Duke MyChart or the MyDuke Health app between February 18, 2019, and June 17, 2022). Notice was mailed and emailed to identified Class Members; some may not have received it due to address changes. Does staying in the class affect my right to sue later?
If you do not opt out by July 20, 2026, you remain in the Class and are bound by the Settlement's release. That means you cannot separately sue Duke Health over its use of tracking tools or the alleged pixel disclosure described in this case. To opt out, mail a signed letter to the Settlement Administrator (P.O. Box 4214, Portland, OR 97208-4214) postmarked no later than July 20, 2026. The letter must include the case name and number, your full name, address, telephone number, your original signature, and a statement that you wish to be excluded. You may only opt out for yourself.
When will payments be sent out?
The Court will hold the Final Approval Hearing on August 27, 2026 at 9:30 a.m. ET at 324 W. Market St., Greensboro, NC 27401. Payments are issued only after the Court grants final approval and any appeals are resolved. The appeal process can take a year or more.
