What happened
Progressive Health and Rehab Corp. filed this class action in the U.S. District Court for the District of New Jersey, alleging that Indegene, Inc., Indegene Encima, Inc., Indegene Wincere Incorporated, and Indegene Healthcare, LLC violated the Telephone Consumer Protection Act, 47 U.S.C. § 227, by sending fax advertisements without the recipients' express invitation or permission. The fax at issue, sent on or about February 7, 2020, promoted a medical record review of adverse events associated with anti-Parkinson's disease medications and offered a $250 honorarium per eligible patient.
Defendants deny the allegations and any wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of further litigation. Under the Settlement Agreement, any unclaimed amounts, including uncashed checks, revert to Defendants rather than going to a third party.
How to file a claim
-
1. Confirm your fax number received the fax
The class covers owners of fax numbers that were successfully sent the February 7, 2020 fax about an anti-Parkinson's medication medical record review offering a $250 honorarium. Notices were sent by September 10, 2026. If you are unsure whether your number is on the list, call Analytics Consulting at (855) 951-0178.
-
2. Understand your payment
Each valid, timely claim is eligible for up to $250, and only one claim per fax number will be approved. If valid claims plus fees, expenses, the incentive award, and administration costs would exceed the fund, claimants receive a pro rata share instead. If you held more than one fax number that received the fax, list each one.
-
3. File your claim online, by mail, or by fax
File online at the official claim form by December 9, 2026. You can also print the paper Claim Form and mail it to Progressive v Indegene, Inc., c/o Analytics Consulting LLC, PO Box 2007, Chanhassen, MN 55317-2007, or fax it to 952-997-0136. No Claim ID is needed; you provide your contact information and fax number(s) and sign a certification. The Notice and Settlement Agreement are posted at IndegeneTCPASettlement.com.
-
4. Receive your check
Approved claimants will be mailed a check after the Court grants final approval and the settlement becomes effective. Checks are void 120 days after they are issued, so cash yours promptly. Keep your mailing address current with the Settlement Administrator.

Where the money is going
Defendants agreed to pay up to $4,717,250, which equals $250 for each of the roughly 18,869 faxes sent. Class Counsel's fees, the incentive award, and administration costs are paid from the fund. Valid claimants receive up to $250 each, reduced pro rata only if claims and costs would exceed the fund. Unclaimed amounts revert to Defendants.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. The amount available for claimants is our own estimate and does not account for administration costs. Unclaimed funds and uncashed checks revert to Defendants.
Common questions
How much money will I receive?
Each valid claim is eligible for up to $250, with one claim approved per fax number. If total claims plus fees, the incentive award, and administration costs would exceed the up to $4,717,250 fund, claimants receive a pro rata share instead.
Do I need to submit proof of purchase?
No documents are required. You list your contact information and fax number(s) and sign a certification under penalty of perjury that the number was yours or your company's in February 2020. The Administrator reviews claims for completeness and plausibility.
What if I didn’t receive a notice?
You do not need a notice or Claim ID to file. If your business owned a fax number that received the February 7, 2020 fax, you can file online at progressiveindegene.claims-administrator.com or contact Analytics Consulting at (855) 951-0178 before December 9, 2026.
Does staying in the class affect my right to sue later?
Unless you exclude yourself by December 9, 2026, you release claims against Defendants related to the facts alleged in the lawsuit, including the faxes sent on or about February 7, 2020. If you do nothing, you are still bound by the release but receive no payment.
When will payments be sent out?
Checks are mailed after the Court grants final approval at the January 12, 2027 hearing and the settlement becomes effective. Any appeal could delay payment. Checks expire 120 days after issuance.
