Teleflora TCPA Text Message Class Action Settlement

Teleflora LLC has agreed to a $6 million settlement over allegations that it sent promotional text messages to telephone numbers listed on the National Do Not Call Registry without consent, in violation of the Telephone Consumer Protection Act (TCPA) and the Virginia Telephone Privacy Protection Act. People in the United States who did not give Teleflora their number and received more than one promotional Teleflora text within a 12-month period, on or after May 9, 2021, while their number was on the Do Not Call Registry, can submit a Claim Form by November 17, 2026. Each approved claim can receive up to $251, less its share of administration costs and attorneys' fees.

You are a Class Member if ALL of the following apply:

  • You live in the United States and did not provide your telephone number to Teleflora LLC.
  • Teleflora delivered, or caused to be delivered, more than one text message promoting Teleflora goods or services to your residential or cellular number within a 12-month period, from May 9, 2021 through the date of preliminary approval.
  • Your number had been registered on the National Do Not Call Registry for at least 30 days before Teleflora sent at least two of those text messages.
  • The parties estimate the class includes approximately 23,844 telephone numbers. Even if you did not get a postcard notice, you may still be included if your number appears in the calling records obtained in the case.
  • Excluded: Anyone who provided their telephone number to Teleflora, and anyone who submits a timely request for exclusion.

What happened

Plaintiff Vickie Carter filed this proposed class action in the Circuit Court for Miami-Dade County, Florida, alleging that Teleflora LLC violated the federal Telephone Consumer Protection Act and the Virginia Telephone Privacy Protection Act by sending telemarketing text messages to telephone numbers on the National Do Not Call Registry without consent. For settlement purposes, the parties estimate the class consists of approximately 23,844 telephone numbers.

Teleflora denies the allegations and denies that it violated the law. The Court has not decided who is right or wrong. The parties agreed to settle to avoid the cost, risk, and time of continued litigation. On August 26, 2026, the Honorable Mavel Ruiz entered an order preliminarily approving the Settlement, conditionally certifying the class for settlement purposes, and scheduling a remote Final Approval Hearing for November 25, 2026.

How to file a claim

  • 1. Confirm you are eligible

    You qualify if you did not give Teleflora your phone number, and Teleflora sent more than one promotional text message to your number within a 12-month period on or after May 9, 2021, while the number had been on the National Do Not Call Registry for at least 30 days. If you are unsure, call the Administrator at 1-833-662-3434 to check your number against the calling records.

  • 2. Estimate your payment

    The Settlement creates a $6,000,000 fund. Each approved claim can receive up to $251, less its share of Settlement administration expenses and any attorneys' fees the Court awards. Class Counsel may ask for attorneys' fees of up to one-third of the settlement fund plus reimbursement of litigation expenses. Only one claim is allowed per telephone number.

  • 3. File online or by mail

    Submit the Claim Form online at TFSettlement.com by 11:59 p.m. PT on November 17, 2026, or mail a paper Claim Form postmarked by November 17, 2026 to: Teleflora TCPA Settlement Administrator, ATTN: CLAIM FORMS, 1650 Arch Street, Suite 2210, Philadelphia, PA 19103. The Claim Form asks for the identification number on your notice, if you received one, and the telephone number(s) that received the texts. You must confirm that you received at least two promotional texts from Teleflora in a 12-month period while registered on the Do Not Call Registry and that you did not give Teleflora your number.

  • 4. Receive your payment

    Payments for approved claims are mailed by check to the address on your Claim Form. Payments are sent only after the Court grants final approval and after any appeals are resolved. The appeal process can take a year or more. Keep your address current with the Administrator.

The Final Approval Hearing is scheduled for November 25, 2026 at 9:00 a.m. Eastern Time and will be held remotely before the Honorable Mavel Ruiz of the Circuit Court for Miami-Dade County, Florida. The deadline to submit a claim, request exclusion, or object is November 17, 2026. The Court may change the hearing date or format, so check TFSettlement.com for updates.

Teleflora has agreed to a $6,000,000 settlement. Each approved claim is capped at $251, and each claimant's payment is reduced by a share of Settlement administration expenses and any attorneys' fees and expenses the Court awards.

The attorneys' fee figure is an estimate based on the one-third cap stated in the Notice, and the Court may award less. Each approved claim receives no more than $251, less its share of administration expenses and the fee award.

How much money will I receive?

Each approved claim can receive up to $251, less that claimant's share of Settlement administration expenses and any attorneys' fees the Court awards. The Settlement Fund is $6,000,000, and Class Counsel may request attorneys' fees of up to one-third of the fund plus litigation expenses. Only one claim is allowed per telephone number, so the actual amount you receive will likely be less than $251.

Do I need to submit proof of purchase?

The Claim Form does not ask you to attach phone records or screenshots. You provide your contact information, the telephone number(s) that received the texts, and confirm under the Claim Form's attestation that you received at least two promotional Teleflora texts in a 12-month period while your number was on the National Do Not Call Registry, and that you did not give Teleflora your number. Claims are checked against the calling records obtained in the case.

What if I didn’t receive a notice?

Yes, you may still be included. According to the Notice, even if you did not get a postcard, you may still be part of the class if your phone number appears in the calling records obtained for this case. Call the Settlement Administrator at 1-833-662-3434 to check your number, or visit TFSettlement.com. The Claim Form asks for the identification number printed on your notice, so contact the Administrator if you do not have one.

Does staying in the class affect my right to sue later?

Yes. Unless you submit a request for exclusion postmarked by November 17, 2026, you cannot sue or be part of any other lawsuit, arbitration, or proceeding against Teleflora or the other Released Parties about the issues in this case. When will payments be sent out?

Payments are mailed by check only after the Court grants final approval at the November 25, 2026 Final Approval Hearing and after any appeals are resolved. Appeals can take a year or more. Check TFSettlement.com for updates and keep your mailing address current.
