What happened

Tenants filed this class action in the Circuit Court of Jackson County, Missouri on April 7, 2023, seeking rent refunds and damages over conditions at Stonegate Meadows Apartments in Kansas City. The claims include habitability, negligence, breach of contract, and Missouri Merchandising Practices Act theories, and the settlement addresses German cockroaches, rodents, bed bugs, roof leaks, brown water in sewage lines, and water intrusion and mold around tub and shower surrounds. The case resulted in four settlements with different owners and managers of the property over different time periods.

The settling defendants deny the claims, and the Court has not decided who is right. They agreed to settle to avoid the cost and risk of continued litigation. Beyond the $2,000,000 fund, Stonegate LLC agreed to forgive Covered Rental Debt, keep a licensed pest control contract for at least 36 months, replace all roofs within three years, inspect and repair main sewage lines, and remediate reported leaks and mold, unless the property is sold first. Earlier settlements with Stonegate Meadows, L.P. and Eagle Point Management ($950,000), Yarco Company ($330,000), and Young Management Corporation ($700,000) were heard in November 2025.
