Institute for Human Resources and Services, Inc. (IHRS) agreed to settle a class action over an August 2025 cyberattack that accessed files containing names, dates of birth, Social Security numbers, driver's license numbers, and medical information. Class members can claim a $45 cash payment with no documentation, or reimbursement of up to $2,000 in documented losses, and can enroll in two years of credit monitoring. Do you qualify?
You are a Class Member if ALL of the following apply:
- You are an individual within the United States whose Private Information was accessed in the IHRS Data Breach.
- The Data Breach was an August 2025 cyberattack on IHRS computers involving files with names, dates of birth, Social Security numbers or ITINs, driver's license or state ID numbers, medical record numbers, and medical history or diagnosis information.
- The $45 alternative cash payment requires no documentation. Documented loss claims require supporting records.
- Excluded: Directors, officers, and agents of IHRS and its affiliated entities, governmental entities, and the assigned judge, the judge's immediate family, and court staff.
- Excluded: Anyone who opts out of the settlement by the November 2, 2026 deadline.

What happened
The lawsuit concerns an August 2025 cyberattack on the computers of Institute for Human Resources and Services, Inc. (IHRS). According to the settlement website, certain files containing private information were accessed, potentially including names, dates of birth, Social Security numbers or individual taxpayer identification numbers, driver's license or state ID numbers, medical record numbers, and medical history, condition, treatment, or diagnosis information.
IHRS denies any wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. This is a claims-made settlement with no fixed fund. IHRS pays benefits to class members with valid claims and pays attorneys' fees, costs, and the service award separately.
How to file a claim

1. Confirm you are eligible
You qualify if you are an individual in the United States whose Private Information was accessed in the August 2025 IHRS Data Breach. Notices were sent to class members by postcard and/or email. If you are unsure, call the Settlement Administrator at (888) 836-1710.

2. Choose your benefits
You can claim Cash Payment A, reimbursement of up to $2,000 for documented out-of-pocket losses such as identity theft costs, credit monitoring fees, ID replacement, and postage incurred between August 13, 2025 and December 2, 2026. As an alternative, you can choose Cash Payment B, a one-time $45 payment with no documentation. All class members can also enroll in two years of CyEx Financial Shield Complete with $1 million in fraud insurance using the enrollment code sent with the notice.

3. File online or by mail
Submit the Claim Form online at the official claim portal by December 2, 2026, or mail a paper Claim Form postmarked by that date to IHRS Data Breach Settlement, P.O. Box 25226, Santa Ana, CA 92799-9958. The online form requires the LoginID and PIN printed on the Notice you received. Documented loss claims require bank statements, receipts, or similar records. If you need your credit monitoring enrollment code, use the enrollment instructions request form.

4. Receive your benefits
Cash payments are sent after the Court grants final approval at the December 17, 2026 Final Approval Hearing and any appeals are resolved. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for Thursday, December 17, 2026 at 9:30 a.m. ET by teleconference before the Court of Common Pleas of Luzerne County, Pennsylvania. The Court will also consider Class Counsel's request for up to $120,000 in attorneys' fees and costs and a $1,500 service award for the Class Representative, both paid separately by IHRS. Opt-out requests and objections are due by November 2, 2026. The Court may move the hearing, so check InstituteHRDataSettlement.com for updates.
Where the money is going
This is a claims-made settlement with no fixed total fund. IHRS will pay benefits to each class member who submits a valid claim, up to the limits below. Attorneys' fees, costs, and the service award are paid by IHRS separately, so they do not reduce class member payments.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested.
Common questions
How much money will I receive?
You can claim up to $2,000 for documented out-of-pocket losses related to the Data Breach, or choose a one-time $45 cash payment with no documentation instead. All class members can also enroll in two years of CyEx Financial Shield Complete with $1 million in fraud insurance. Payments depend on a valid claim and Court approval.
Do I need to submit proof of purchase?
Not for the $45 cash payment. Documented loss claims require supporting records, such as bank statements or receipts, and self-created notes alone are not enough.
What if I didn’t receive a notice?
The class includes all individuals in the United States whose Private Information was accessed in the Data Breach. Notices with a LoginID and PIN were sent by postcard and/or email, and the online Claim Form requires them. If you believe you were affected but did not get a notice, call the Settlement Administrator at (888) 836-1710 before the December 2, 2026 deadline.
Does staying in the class affect my right to sue later?
If you stay in the settlement, you give up the right to pursue a separate lawsuit against IHRS over the issues resolved by this settlement, whether or not you file a claim. To keep those rights, you must opt out by November 2, 2026.
When will payments be sent out?
Payments are sent after the Court grants final approval at the December 17, 2026 Final Approval Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
