KYB Americas Corporation has agreed to a settlement over a February 2025 data security incident in which certain files containing personal information were potentially accessed. Class members whose personal information was compromised can claim three years of credit monitoring plus cash reimbursement, or a no-proof flat payment, by August 26, 2026.

Do you qualify?
You are a Class Member if ALL of the following apply:
- You reside in the United States and your personal information was compromised in the data security incident KYB discovered in February 2025.
- You are included whether or not you received a breach notice directly from KYB, as long as your personal information was compromised in the incident.
- Excluded: KYB and its officers, directors, and related companies; anyone who validly excludes themselves from the Settlement; the Judge in this case and the Judge's family and staff; and anyone who perpetrated the Data Security Incident.

What happened
The lawsuit alleges that during a targeted data security incident on KYB's computer systems in February 2025, certain files containing personal information were potentially accessed.
KYB denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle to avoid the costs, risks, disruptions, and uncertainties of continuing the litigation.
How to file a claim

1. Confirm you are eligible
You qualify if you are a U.S. resident whose personal information was compromised in the February 2025 KYB data security incident, whether or not you received a breach notice.

2. Tally up your claim
All class members can claim three years of credit monitoring at no cost. For cash, choose either documented ordinary losses (up to $300), documented extraordinary losses from identity theft or fraud (up to $5,000), and up to four hours of lost time ($25/hour, capped at $100), or a no-proof flat payment (expected to be $75). Cash payments are capped in aggregate at $250,000 and will be reduced pro rata if claims exceed that amount.

3. File online or by mail
Submit the Claim Form online at kybdatasettlement.com/form/claim by August 26, 2026, or mail a paper Claim Form (postmarked by August 26, 2026) to: KYB Data Security Incident Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799.

4. Receive your payment
Payments are issued after the Court grants final approval at the September 25, 2026 Fairness Hearing and any appeals are resolved. The appeal process can take a year or more. No follow-up is required once your claim is submitted.

The Fairness Hearing is scheduled for September 25, 2026 at 11:15 a.m. Eastern Time via WebEx. The Court may move the hearing, so check KYBDataSettlement.com for updates before making plans.
Where the money is going
This settlement uses an aggregate cap on cash payment options rather than a single common fund. All class members also receive three years of credit monitoring at no cost, which is not counted against the cash cap.
Attorneys' fees, costs, and the service award are requested amounts pending Court approval at the Fairness Hearing and are paid by KYB separately from the $250,000 cash cap. If valid cash claims exceed $250,000 in total, cash payments will be reduced on a pro rata basis.

How much money will I receive?
All class members can claim three years of free credit monitoring. Total cash payments are capped at $250,000 and will be reduced pro rata if claims exceed that amount.
Do I need to submit proof of purchase?
Ordinary losses, extraordinary losses, and lost time claims must be attested to and supported by documentation, though self-prepared documents like handwritten receipts alone are not sufficient. The alternative $75 cash payment requires no proof or explanation.
What if I didn’t receive a notice?
Class membership is based on whether your personal information was compromised in the February 2025 incident, not on whether you received a breach notice. If you are unsure whether you are a class member, contact the Settlement Administrator.
Does staying in the class affect my right to sue later?
If you stay in the class, you give up the right to sue KYB separately over the claims resolved by this settlement. The full release is described in Section IX of the Settlement Agreement. You can opt out by July 27, 2026 to keep your right to sue on your own.
When will payments be sent out?
Payments are issued after the Court's September 25, 2026 Fairness Hearing, assuming final approval, and after any appeals are resolved. Appeals can take a year or more to resolve.
