What happened

Plaintiffs Julianne Cook, Domonique Barlow, and Katherine Heldreth filed this proposed class action against Legends Hospitality, LLC, alleging that targeted cyberattacks on the company's computer systems in November 2024, December 2024, and January 2025 (the "Data Incidents") allowed an unauthorized party to access files containing Private Information, including names, dates of birth, Social Security numbers, driver's license numbers, government ID numbers, financial information, medical information, and health insurance information.

Legends Hospitality denies it did anything wrong, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and time of continued litigation. Legends Hospitality will establish an $812,900 non-reversionary common Settlement Fund, out of which the Court will approve attorneys' fees and costs (Class Counsel will request up to one-third of the fund), Service Awards of $2,500 to each of the three Class Representatives, and administration costs. The remainder funds three years of credit monitoring for every Settlement Class Member plus a cash payment: either reimbursement of documented out-of-pocket losses up to $5,000, or a no-proof pro rata Alternate Cash payment estimated at $200.

Common questions

How much money will I receive?

You can claim one of two cash options. Cash Payment A reimburses documented out-of-pocket losses up to $5,000, for losses incurred between November 9, 2024 and August 19, 2026, with receipts or other proof required. Cash Payment B is a one-time Alternate Cash payment, currently estimated at $200 with no proof required, though the final amount may be higher or lower depending on how many valid claims are filed. Every Settlement Class Member can also enroll in three years of CyEx Financial Shield Total credit monitoring with $1 million in fraud insurance, regardless of which cash option is chosen.

Do I need to submit proof of purchase?

For the Alternate Cash payment (~$200) and for credit monitoring, no proof is required. For the Documented Losses payment (up to $5,000), you must send receipts or similar documentation showing how much you spent or lost because of the Data Incidents. Personal certifications, declarations, or affidavits alone do not count as reasonable documentation, though they may support other proof you submit. You cannot claim expenses already reimbursed by a third party.

What if I didn’t receive a notice?

Legends Hospitality's records were used to identify Settlement Class Members. If you believe your Private Information was involved in the November 2024, December 2024, or January 2025 Data Incidents but did not receive a notice, contact the Settlement Administrator at 1-833-421-7268 or info@LegendsDataSettlement.com to confirm your Class Member status before the claim deadline.

Does staying in the class affect my right to sue later?

Yes. Unless you exclude yourself (opt out) by mailing a written Opt-Out Request postmarked by August 4, 2026, you will remain in the Settlement Class and will give up the right to sue, continue to sue, or be part of another lawsuit against Legends Hospitality over the claims resolved by this Settlement. The full release is described in Section XIII of the Settlement Agreement, available at LegendsDataSettlement.com.

When will payments be sent out?

The Court will hold the Final Approval Hearing on September 3, 2026 at 10:00 a.m. Eastern Time. If the Court grants final approval, credit monitoring enrollment and cash payments are distributed after final approval and after any appeals are resolved. The appeal process can take a year or more. No action is required after a valid Claim Form is submitted.
