What happened
Plaintiffs Sally Andersen and Michael Kemmerlin filed this proposed class action against Oak View Group, LLC, a Denver-based global venue management and live entertainment company, alleging that in November 2023 a targeted cyberattack on Oak View's computer systems accessed files containing class members' Personally Identifiable Information, including full names, dates of birth, Social Security numbers, demographic information, and driver's license or state or federal identification numbers. Oak View provided breach-notice letters to affected individuals on or around January 2024. The complaint asserts the company failed to adequately safeguard the PII entrusted to it, leaving class members exposed to identity theft and fraud.
Oak View Group denies the allegations and denies that it did anything wrong. The Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and time of continued litigation. Oak View will establish an $824,000 non-reversionary common Settlement Fund, out of which the Court will approve attorneys' fees and costs (Class Counsel will request one-third of the fund), Service Awards of $2,500 to each of the two Class Representatives, and administration costs. The remainder funds three classes of benefits to claimants: reimbursement of documented out-of-pocket losses up to $5,000 per claim, a one-time pro rata cash payment (estimated at $150 for California residents and $50 for everyone else), and two years of CyEx Identity Defense Complete credit monitoring with $1 million in identity-theft insurance.

Where the money is going
This is a non-reversionary common fund. Court-approved attorneys' fees and costs (Class Counsel will seek one-third of the fund), Service Awards to the two Class Representatives, and administration costs all come out of the $824,000 Settlement Fund first. The remainder funds documented out-of-pocket reimbursements (up to $5,000 per claim), pro rata cash payments, and the two-year CyEx Identity Defense Complete monitoring benefit for all class members.
All amounts listed above are pending and subject to final court approval at the August 13, 2026 Final Approval Hearing. The Court may award less than the amounts requested. The pro rata cash amounts ($150 for California residents, $50 for residents of all other states) are estimates from the Notice and may be larger or smaller depending on the total claims filed.
Common questions
How much money will I receive?
The Notice estimates a one-time pro rata cash payment of $150 for California residents and $50 for residents of all other states, with no proof required. You can also claim reimbursement of up to $5,000 in documented out-of-pocket losses (identity theft, credit reports, monitoring, ID replacement, postage to banks) with bank statements or receipts, for expenses incurred between November 26, 2023 and August 15, 2026. Every class member is also eligible for two years of CyEx Identity Defense Complete credit monitoring with $1 million in identity-theft insurance. The pro rata cash amounts may be larger or smaller depending on the total claims filed.
Do I need to submit proof of purchase?
For the pro rata cash payment ($150 CA / $50 other states), no documentation is required, just submit the Claim Form. For documented out-of-pocket loss reimbursement, you must include bank statements, receipts, or similar proof of how much you spent or lost due to the breach. Self-prepared notes alone are not enough. You cannot claim expenses already reimbursed by a third party. For credit monitoring, no proof is required.
What if I didn’t receive a notice?
Yes. You can still file a claim even if you did not receive a direct notice. If your PII was compromised in the November 2023 Oak View Group data breach and Oak View sent you a breach-notice letter in or around January 2024, you are likely a Class Member. Contact the Settlement Administrator toll-free 24/7 at 1-833-386-6569, email info@OakViewGroupDataSettlement.com, or visit OakViewGroupDataSettlement.com to confirm your status and request a Claim Form.
Does staying in the class affect my right to sue later?
Yes. Unless you submit a written Request for Exclusion postmarked by July 16, 2026, you will be bound by the Settlement and will release your claims against Oak View Group, LLC relating to the November 2023 Data Incident. The full release language is in Section XIII of the Settlement Agreement, available on the Documents page of OakViewGroupDataSettlement.com.
When will payments be sent out?
If the Court grants final approval at the August 13, 2026 Final Approval Hearing, payments and credit-monitoring enrollment will be distributed after the judgment becomes final and any appeals are resolved. If anyone appeals the settlement, payment may be delayed by the appeal, which can take a year or more. No action is required after a valid Claim Form is submitted.
