Limetree Bay Refinery Class Action Settlement

Seven groups of defendants tied to the Limetree Bay Refinery on St. Croix agreed to settlements totaling $59,795,000 over chemical releases from the refinery between February and May 2021. People and businesses who owned or rented property, lived, worked, or were present in the western portion of St. Croix during that period can file a claim. Payments are calculated under a pro rata point system based on the harm claimed. The claim deadline is November 3, 2026.

Do you qualify?

  • You owned or rented property in the Affected Geographic Area on or after February 3, 2021.
  • Or you resided in, worked in, owned or operated a business in, or were present in the Affected Geographic Area between February 3, 2021 and May 26, 2021.
  • The Affected Geographic Area is the western portion of St. Croix, bounded by 64.74 degrees West Longitude and the sea. A map is posted on the settlement website.
  • Both persons and entities, including businesses, can be class members.

What happened

The lawsuits concern the failed restart of the Limetree Bay Refinery on St. Croix, U.S. Virgin Islands. Plaintiffs allege that hazardous and toxic chemicals, substances, gases, and odors were released from the refinery in incidents on February 4, April 23, May 5, and May 12, 2021, and that the releases caused property damage, including contamination of water cisterns, nuisance, trespass, economic losses, physical and emotional health effects, and unreimbursed out-of-pocket expenses. The refinery shut down in May 2021.

The Settling Defendants deny all allegations and any liability, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. These settlements resolve claims only against the Settling Defendants. Plaintiffs have not settled with the remaining defendants and will continue to litigate against them.

How to file a claim

  • 1. Confirm you are eligible

    You qualify if you owned or rented property in the western portion of St. Croix on or after February 3, 2021, or lived, worked, ran a business, or were present there between February 3 and May 26, 2021. Check the map of the Affected Geographic Area on the settlement website, or call 1-888-859-9973.

  • 2. Gather your documentation

    Payments are calculated with a pro rata point system that accounts for the harm you claim, including property damage and water cistern contamination, nuisance, trespass, economic losses, physical and emotional health effects, and unreimbursed out-of-pocket expenses. The Claim Form asks for all requested information and documentation supporting your claim. Health-related claims may also require a Lien Disclosure Form, which is posted on the Documents page.

  • 3. File online or by mail

    Submit a Claim Form through the official claim portal by November 3, 2026, or mail a paper Claim Form to Limetree Bay Settlement Administrator, P.O. Box 2420, Portland, OR 97208-2420. The online portal asks for the 10-character Unique ID and 4-digit PIN printed on the Postcard Notice. If you did not receive them, call 1-888-859-9973 to get a Confirmation Code before filing. The Claim Form, Claim Payment Formula, and settlement agreements are posted at LimetreeBaySettlement.com.

  • 4. Receive your payment

    The Settlement Administrator will issue payments within 120 days after the Effective Date, which follows final approval at the December 14, 2026 Final Approval Hearing and the resolution of any appeals. Checks remain valid for 180 days, so cash yours promptly.

The Final Approval Hearing is scheduled for Monday, December 14, 2026 at 9:30 a.m. AST at the Almeric L. Christian Federal Building and Courthouse, 3013 Estate Golden Rock, Suite 219, St. Croix, Virgin Islands 00820. The Court will also consider Class Counsel's request for attorneys' fees of up to one-third of the Gross Settlement Fund plus costs, and service awards of up to $5,000 for each Class Representative. Opt-out requests and objections must be postmarked by October 27, 2026. The Court may move the hearing, so check LimetreeBaySettlement.com for updates.

Where the money is going

Seven groups of Settling Defendants will pay a combined $59,795,000 into a Gross Settlement Fund. The fund covers payments to class members with valid claims, settlement administration costs, attorneys' fees and costs, and service awards. What remains is divided among valid claims under a pro rata point system, so individual payments depend on the harm claimed and the total number of points awarded.

All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. Individual payments are not fixed and depend on the points assigned under the Claim Payment Formula and the total number of valid claims.

Common questions

How much money will I receive?

There is no fixed payment amount. After fees, costs, service awards, and administration costs are deducted from the $59,795,000 Gross Settlement Fund, the remainder is divided among valid claims using a pro rata point system. Your share depends on the categories of harm you claim and document, and on the total points awarded to all claimants.

Do I need to submit proof of purchase?

Yes. The Claim Form asks for all requested information and documentation supporting your claim, such as proof that you owned or rented property, lived, worked, or were present in the Affected Geographic Area, and records of the harm you claim. Review the Claim Form and Claim Payment Formula on the settlement website for the specific requirements.

What if I didn’t receive a notice?

You may still be a class member if you meet the class definition. The online portal asks for the Unique ID and PIN from the Postcard Notice. If you did not receive one, call the Settlement Administrator at 1-888-859-9973 to get a Confirmation Code before the November 3, 2026 deadline.

Does staying in the class affect my right to sue later?

If you stay in the settlements, you release your claims against the Settling Defendants and other Released Parties related to the refinery release incidents, including unknown claims, whether or not you file a claim. The release does not cover the non-settling defendants. To keep your rights against the Settling Defendants, you must opt out by October 27, 2026.

When will payments be sent out?

Payments are issued within 120 days after the Effective Date, which comes after the Court grants final approval at the December 14, 2026 Final Approval Hearing and any appeals are resolved. An appeal can add a year or more to that timeline.
