What happened

The lawsuit claims that American Well Corp. (Amwell) disclosed its customers' medical information and confidential communications to third parties, without permission, through the appointment booking tool on LiveHealth Online. The plaintiffs allege this violated the Federal Wiretap Act, the California Invasion of Privacy Act, the California Confidentiality of Medical Information Act, the California Constitution, and common law.

Amwell denies that it violated any law, and the Court has not decided who is right. Amwell agreed to settle to avoid the uncertainties and expenses of continuing the case. The $2,037,751.46 Settlement Fund pays equal pro rata payments to class members who file valid claims, after settlement administration expenses, attorneys' fees and costs, and any incentive award.

How to file a claim

  • 1. Confirm you are eligible

    You qualify if you used the appointment booking tool on LiveHealth Online, through the website, iOS app, or Android app, between October 2024 and August 2025. If you are unsure, call the Settlement Administrator at (888) 369-3797.

  • 2. Understand the payment

    There is one benefit: an equal pro rata share of the net Settlement Fund for each class member who files a valid claim. The settlement website estimates payments of about $51.14 to $102.29 per person. The final amount depends on the number of valid claims and the fees and costs the Court approves. You can choose a check, PayPal, or Venmo.

  • 3. File online or by mail

    Submit the Claim Form online at the official claim portal by October 30, 2026, or download a paper Claim Form and mail it to LiveHealth Online Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799-9958 by that date. The online form asks for the LoginID and PIN printed on the Notice sent to you. If you did not receive a Notice, contact the Settlement Administrator at (888) 369-3797 or info@LiveHealthOnlineSettlement.com. The Notice and FAQs are posted at LiveHealthOnlineSettlement.com.

  • 4. Receive your payment

    Payments are sent about 45 days after the Court grants final approval at the January 15, 2027 Final Approval Hearing and any appeals are resolved. Checks are valid for 180 days. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for Friday, January 15, 2027 at 9:00 a.m. in Department 8A of the Sacramento County Hall of Justice. The Court will also consider Class Counsel's request for attorneys' fees of up to one-third of the fund plus costs and an incentive award of up to $5,000 for the class representative. Opt-out requests and objections are due by October 30, 2026. The Court may move the hearing, so check LiveHealthOnlineSettlement.com for updates before traveling.

Where the money is going

Amwell will pay $2,037,751.46 into a Settlement Fund. The fund covers equal pro rata payments to class members who submit valid claims, settlement administration and notice expenses, attorneys' fees and costs, and the class representative's incentive award. Because payments are pro rata, the final amount per claimant depends on how many valid claims are filed.

Do I need to submit proof of purchase?

No proof of harm or loss is described. You need to submit a valid Claim Form confirming you used the LiveHealth Online appointment booking tool during the class period. The online form asks for the LoginID and PIN on your Notice.

What if I didn’t receive a notice?

The online Claim Form uses the LoginID and PIN printed on the Notice. If you used the LiveHealth Online appointment booking tool between October 2024 and August 2025 but did not receive a Notice, contact the Settlement Administrator at (888) 369-3797 or info@LiveHealthOnlineSettlement.com, or download the paper Claim Form, before the October 30, 2026 deadline.

Does staying in the class affect my right to sue later?

If you stay in the settlement, you release Amwell and certain affiliates from the claims resolved by this settlement, whether or not you file a claim. To keep your right to sue over these claims, you must opt out by October 30, 2026.

When will payments be sent out?

Payments are distributed about 45 days after the Court grants final approval at the January 15, 2027 Final Approval Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
