Do you qualify?
You are a Class Member if ALL of the following apply:
- Your personal identification information was stored in CUSO's systems at the time of the cybersecurity incident that occurred between December 19, 2023 and January 19, 2024, and you were impacted by it.
- If you were also a California resident on December 19, 2023, you are part of the California Subclass and may claim an additional California Statutory Payment.
- Excluded: CUSO's officers and directors, the presiding judge and the judge's staff and immediate family, and anyone convicted of initiating or aiding the incident.
- Excluded: Anyone who opts out of the settlement by the October 1, 2026 deadline.

What happened
The lawsuit concerns a cybersecurity incident at CUSO Financial Services, L.P. (CUSO). According to the settlement notice, an unauthorized individual accessed one CUSO employee's account on a third-party service provider's platform between December 19, 2023 and January 19, 2024. CUSO became aware of the incident on January 19, 2024 and disclosed it in October 2024. The settlement class is estimated at about 76,251 people.
CUSO denies all allegations and any wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. The $1,750,000 Settlement Fund pays class member benefits as well as claims administration costs, any service award, and attorneys' fees and expenses.

1. Confirm you are eligible
You qualify if your personal identification information was stored in CUSO's systems and impacted by the cybersecurity incident that occurred between December 19, 2023 and January 19, 2024. California residents as of December 19, 2023 are also part of the California Subclass. If you are unsure, call the Settlement Administrator at 866-356-5835.

2. Choose your benefits
The settlement offers reimbursement of up to $5,000 for documented losses traceable to the incident, two years of three-bureau credit monitoring through IDX, a California Statutory Payment of up to $100 for California Subclass members, and a Residual Cash Payment of up to $599 paid pro rata from funds remaining after other benefits and costs. Credit monitoring may be claimed in addition to, or instead of, the cash benefits. The residual amount is not guaranteed and depends on the number of valid claims.

3. File online or by mail
Submit the Claim Form online at the official claim portal by November 16, 2026, or mail a paper Claim Form postmarked by that date to CUSO Data Settlement, c/o Analytics Consulting LLC, PO Box 2010, Chanhassen, MN 55317-2010. The online portal asks for the Claim Number and PIN printed on your notice. Documented loss claims require supporting documentation, and California Statutory Payment claims require proof of California residency on December 19, 2023. The notice, Claim Form, Settlement Agreement, and Preliminary Approval Order are posted at CUSOCybersecurityIncident.com.

4. Receive your benefits
Cash payments and credit monitoring enrollment are provided after the Court grants final approval at the February 18, 2027 Final Approval Hearing and any appeals are resolved. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for Thursday, February 18, 2027 at 8:30 a.m. PT in Department 1 of the Superior Court of California, County of Tulare, 221 S. Mooney Blvd., Visalia, California 93291. The Court will also consider Class Counsel's request for attorneys' fees and expenses and a service award, which are paid from the Settlement Fund. Opt-out requests must be postmarked, and objections received, by October 1, 2026. The Court may move the hearing, so check CUSOCybersecurityIncident.com for updates before traveling.
Where the money is going
CUSO will pay $1,750,000 into a non-reversionary Settlement Fund. The fund covers benefits for class members who submit valid claims, all claims administration costs, any service award, and attorneys' fees and expenses. Class Counsel may request up to one-third of the fund in fees, and the Class Representative may request a service award of up to $5,000. Because the residual cash payment is pro rata, the final amount per claimant depends on how many valid claims are filed.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. The Residual Cash Payment of up to $599 is paid pro rata from funds remaining after all other payments and costs, and may be less.

Do I need to submit proof of purchase?
Documented Losses require documentation supporting the out-of-pocket cost. The California Statutory Payment requires proof of California residency on December 19, 2023. Credit monitoring and the Residual Cash Payment are not described as requiring documentation of losses, but you still need to submit a valid Claim Form. The online portal asks for the Claim Number and PIN on your notice.
What if I didn’t receive a notice?
The class includes all persons whose personal identification information was stored in CUSO's systems and impacted by the incident. If you believe you were affected but did not get a notice, Claim Number, or PIN, contact Analytics Consulting LLC at 866-356-5835 or CUSOCybersecurityIncident@noticeadministrator.com before the November 16, 2026 deadline.
Does staying in the class affect my right to sue later?
If you stay in the settlement, you give up the right to sue, continue to sue, or be part of any other lawsuit against CUSO and related parties over claims arising from the cybersecurity incident, known and unknown, including a waiver of California Civil Code Section 1542 rights. This applies whether or not you file a claim. To keep those rights, you must opt out by October 1, 2026.
When will payments be sent out?
Benefits are distributed after the Court grants final approval at the February 18, 2027 Final Approval Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
