- You are an individual residing in the United States.
- You received written notice from Peco that your personally identifiable information may have been compromised in the Data Breach.
- The residual cash payment and credit monitoring do not require documentation of losses.
- Excluded: Anyone who opts out of the settlement by the October 12, 2026 deadline.
- Excluded: The judge and court staff and their immediate families, Peco's officers, directors, members, and shareholders, and anyone convicted of or pleading nolo contendere to initiating or causing the Data Breach.

What happened
The lawsuit concerns a data breach at Peco Foods Inc. that occurred on or around December 4, 2023, in which an unauthorized third party accessed personally identifiable information. Peco later sent written notice to individuals whose information may have been compromised.
Peco denies all allegations and any wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. The $950,000 Settlement Fund pays class member benefits as well as claims administration costs, service awards, and attorneys' fees and costs.

1. Confirm you are eligible
You qualify if you reside in the United States and received written notice from Peco that your personally identifiable information may have been compromised in the Data Breach. If you are unsure, call the Claims Administrator at 1-855-557-9411.

2. Choose your benefits
The settlement offers reimbursement of up to $1,000 for documented ordinary out-of-pocket losses incurred on or after December 4, 2023, and up to $5,000 combined for documented extraordinary losses from identity theft or fraud plus up to 10 hours of attested time at $40 per hour. All claimants can also elect three years of triple bureau credit monitoring, and a residual cash payment of up to $550 is paid from funds remaining after other benefits and costs. 3. File online or by mail
Submit the Claim Form online at the official claim portal by November 9, 2026, or mail a paper Claim Form postmarked by that date to Eisner Advisory Group LLC, P.O. Box 1828, Baton Rouge, LA 70821. The online form asks for the claim ID printed on the settlement notice you received. Documented loss claims require supporting documentation. Notice documents, the Settlement Agreement, and court filings are posted at PecoFoodsDataSettlement.com.

4. Receive your benefits
Cash payments and credit monitoring enrollment are provided after the Court grants final approval at the December 14, 2026 Final Approval Hearing and any appeals are resolved. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for December 14, 2026 at 11:00 a.m. CT at the Tuscaloosa County Courthouse, 714 Greensboro Ave, 2nd Floor, Tuscaloosa, AL 35401. The Court will also consider Class Counsel's request for attorneys' fees of up to $316,666.67, costs of up to $30,000, and $2,500 service awards for each Class Representative, which are paid from the Settlement Fund. Opt-out requests and objections are due by October 12, 2026. The Court may move the hearing, so check PecoFoodsDataSettlement.com for updates before traveling.
Where the money is going
Peco will pay $950,000 into a Settlement Fund. The fund covers documented loss reimbursements, credit monitoring, claims administration costs, service awards, and attorneys' fees and costs. Money remaining after those payments is divided among claimants as a residual cash payment of up to $550, so the final amount per claimant depends on how many valid claims are filed.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. The service award total is an estimate based on nine Class Representatives at $2,500 each. The residual cash payment is not fixed and may be less than $550 depending on the number of valid claims.

How much money will I receive?

The residual payment is not guaranteed and depends on how many valid claims are filed.
Do I need to submit proof of purchase?
Ordinary and extraordinary loss reimbursements require documentation of your unreimbursed losses. The residual cash payment and credit monitoring are not described as requiring documentation, but you still need to submit a valid Claim Form. The online form asks for the claim ID on your settlement notice.
What if I didn’t receive a notice?
The class is limited to people who received written notice from Peco that their information may have been compromised. If you believe you received that notice but lost it or your claim ID, call the Claims Administrator at 1-855-557-9411 or email info@PecoFoodsDataSettlement.com before the November 9, 2026 deadline.
Does staying in the class affect my right to sue later?
If you stay in the settlement, you give up the right to sue, continue to sue, or be part of any other lawsuit against Peco and the other released parties over claims arising out of or relating to the Data Breach, whether or not you file a claim. To keep those rights, you must opt out by October 12, 2026.
When will payments be sent out?
Benefits are distributed after the Court grants final approval at the December 14, 2026 Final Approval Hearing, after any appeals are resolved, and after all Claim Forms are processed. An appeal can add a year or more to that timeline.
