Progressive Texas PIP Late Payment Class Action Settlement

Progressive County Mutual Insurance Company agreed to settle a class action alleging that it paid Personal Injury Protection (PIP) medical bills under Texas auto policies late and did not pay the statutory remedies owed on those late payments. People whose covered PIP medical bills were paid late, with an Explanation of Benefits printed between August 30, 2016 and June 1, 2026, can claim a cash payment calculated by a set formula of interest, plus a flat 5% for bills paid more than 30 days late. The claim deadline is January 19, 2027.

What happened

The lawsuit alleges that Progressive failed to handle Personal Injury Protection (PIP) medical bills within the deadlines set by the Texas Prompt Payment of Claims Act and the Texas Insurance Code, and that it did not pay the statutory remedies owed on every late payment. The class covers PIP medical bill line items under Texas-based policies that Progressive paid late, with EOB print dates from August 30, 2016 through June 1, 2026.

Progressive strongly denies that it violated the statutes at issue or did anything wrong, says it complied with Texas law and its policies, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. Attorneys' fees, costs, and service awards are paid by Progressive separately and do not reduce class member payments.

How to file a claim

  • 1. Confirm you are eligible

You may qualify if a covered PIP medical bill was submitted under your Texas-based Progressive auto policy and Progressive paid a line item on it late, with an EOB print date between August 30, 2016 and June 1, 2026. Class members were identified through Progressive's records and notified by email or postcard. If you are unsure, call 1-888-808-4386.

  • 2. Understand your payment

There are two classes. For the 15-Day Class (EOB issued more than 15 business days after Progressive received the bill), the payment is 11.452% annual interest on the line item's Allowed Amount for the days it was late. For the 30-Day Class (EOB issued more than 30 days after receipt), the payment is a flat 5% of the Allowed Amount plus 11.452% annual interest for the days late. The Settlement Administrator performs the calculation, so amounts vary by claimant.

  • 3. File your claim online

Claim Forms must be submitted online at the official claim portal no later than January 19, 2027. The notice does not describe a mail-in option. If you did not receive a notice or have questions about the form, call the Settlement Administrator at 1-888-808-4386 or write to Koetter v. Progressive Settlement Administrator, c/o Verita Global, LLC, P.O. Box 301132, Los Angeles, CA 90030-1132. The notice and Settlement Agreement are posted at TravisCountyPIPSettlement.com.

  • 4. Receive your payment

Payments are made only after the Court grants final approval at the December 17, 2026 Final Approval Hearing and any appeals are resolved. Because the claim deadline is January 19, 2027, payments will not issue before claims close.

Where the money is going

This is a claims-made settlement with no fixed common fund or payment cap disclosed. Progressive will pay each class member who submits a valid, timely Claim Form an amount calculated under the settlement formula. Class Counsel's requested attorneys' fees and costs and the class representatives' service awards are paid by Progressive separately, and the notice states that notice and administration costs will not reduce the amount available to class members.

Total settlement fund Claims-made, no fixed fund disclosed
15-Day Class, per late line item 11.452% annual interest
30-Day Class, per late line item 5% of Allowed Amount + interest
Attorneys' fees & costs (paid separately by Progressive) Up to $2,000,000
Service awards (2 class representatives, paid by Progressive) Up to $10,000 each

All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. Payments are made only if the Court grants final approval and after any appeals are resolved.

Common questions

How much money will I receive?

Payments depend on how late Progressive paid each line item and that line item's Allowed Amount. 15-Day Class members receive 11.452% annual interest for the late period; 30-Day Class members receive a flat 5% of the Allowed Amount plus 11.452% annual interest. The Settlement Administrator calculates each amount, so no specific figure is guaranteed.

Do I need to submit proof of purchase?

Class members were identified from Progressive's records, and payments are calculated from Progressive's EOB data. You still must submit a valid Claim Form online by January 19, 2027 to be paid. Check the claim portal for the information it asks you to provide.

What if I didn’t receive a notice?

Class members were identified through Progressive's records and notified by email or postcard. If you believe Progressive paid a PIP medical bill under your Texas policy late between August 30, 2016 and June 1, 2026 but you did not receive a notice, call Verita Global at 1-888-808-4386 before the January 19, 2027 deadline.

Does staying in the class affect my right to sue later?

If you stay in the class, you release Progressive and the Released Persons from the Released Claims described in the Settlement Agreement, including claims arising from the facts alleged about PIP claim handling, whether or not you file a claim. To keep those rights, you must mail an exclusion request postmarked by November 12, 2026.

When will payments be sent out?

Payments are made after the Court grants final approval at the December 17, 2026 hearing, after the January 19, 2027 claim deadline, and after any appeals are resolved. An appeal can add a year or more to that timeline.
