Telmate ViaPath Data Breach Class Action Settlement
Telmate, LLC, now doing business as ViaPath Technologies, agreed to a $4,225,000 settlement over a security incident in which unauthorized third parties accessed its computer network between August 11 and August 13, 2020. Anyone in the United States whose personal information was impacted can claim a pro rata cash payment, plus reimbursement of up to $5,000 in documented out-of-pocket losses. The claim deadline is December 21, 2026.

What happened
The lawsuit concerns a security incident in which a malicious third party accessed files on Telmate's computer network between August 11, 2020 and August 13, 2020. Telmate provides communication services for incarcerated people and their families through platforms including GettingOut, VisitNow, Command, Telmate Inmate Telephone, and Guardian. According to the settlement website, the information involved may include full names, dates of birth, phone numbers, email addresses, usernames paired with passwords, home addresses, driver's license and passport numbers, Social Security numbers, payment card numbers, and financial account information. The Settlement Class is about 431,031 people.
Telmate denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. The $4,225,000 fund pays documented loss claims, pro rata cash payments, notice and administration costs, attorneys' fees and costs, and a service award.
How to file a claim

1. Confirm you are eligible
You qualify if you are in the United States and your Personal Information was impacted in the August 2020 Telmate Security Incident. If you are unsure, call the Settlement Administrator at 833-453-3721.

2. Choose your benefits
Every class member who files a valid claim can receive a Pro Rata Cash Payment, which is an equal share of the money left in the fund after documented loss reimbursements, fees, service awards, and administration costs. The amount depends on how many people file. In addition, you can claim reimbursement of documented out-of-pocket losses up to $5,000, which requires supporting documentation such as receipts or account statements.

3. File online or by mail
Submit the Claim Form online at the Kroll claim portal by December 21, 2026. The online form asks for the Class Member ID from your notice. You can also download a paper Claim Form from the Documents page and mail it, postmarked by December 21, 2026, to the address printed on the form. Notice documents, the Settlement Agreement, and court filings are posted at TelmateDataBreachSettlement.com.

4. Receive your payment
Payments are issued after the Court grants final approval at the February 12, 2027 Final Approval Hearing and any appeals are resolved. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for February 12, 2027 at 10:00 a.m. ET at the U.S. District Court for the Eastern District of Virginia. The Court will also consider Class Counsel's request for attorneys' fees of up to $1,408,333.33, costs of up to $35,000, and a $5,000 service award for the Class Representative. Claims, opt-outs, and objections are all due December 21, 2026. The Court may move the hearing, so check TelmateDataBreachSettlement.com for updates before traveling.
Where the money is going
Telmate will contribute $4,225,000 to a Settlement Fund. Documented loss reimbursements, attorneys' fees and costs, the service award, and notice and administration costs are paid from the fund, and the remainder is divided in equal pro rata shares among class members with valid claims.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. The Pro Rata Cash Payment amount is not fixed and depends on the number of valid claims.
Common questions
How much money will I receive?
Each class member with a valid claim receives a Pro Rata Cash Payment, an equal share of what remains in the $4,225,000 fund after documented loss reimbursements, fees, costs, the service award, and administration costs. The amount is not yet known. You can also claim reimbursement of documented out-of-pocket losses up to $5,000.
Do I need to submit proof of purchase?
Not for the Pro Rata Cash Payment. Reimbursement of out-of-pocket losses requires documentation, such as receipts, bills, or bank or credit card statements showing losses that were likely caused by the Security Incident.
What if I didn’t receive a notice?
You may still be able to file. The online Claim Form asks for the Class Member ID printed on your notice. If you did not receive a notice or cannot find your ID, call Kroll Settlement Administration at 833-453-3721 before the December 21, 2026 deadline.
Does staying in the class affect my right to sue later?
If you stay in the settlement, you give up the right to sue Telmate over the claims released by this settlement, whether or not you file a claim. To keep those rights, you must opt out by December 21, 2026.
When will payments be sent out?
Payments come after the Court grants final approval at the February 12, 2027 Final Approval Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
