- You applied for a job opening with ACV Auctions Inc., ACV Capital LLC, or ACV Transportation LLC in Washington State (including remote positions listing Seattle and/or Washington).
- Your application was submitted between January 1, 2023 and July 26, 2025.
- The job posting you applied to did not disclose the wage scale, salary range, or a general description of benefits and other compensation.
- Excluded: ACV employees, officers, directors, agents, and affiliates; individuals who applied outside Washington State; and the judge presiding over the case.

What happened
Washington's Equal Pay and Opportunities Act (RCW 49.58.110) requires employers to include the wage scale or salary range in job postings. Plaintiff Jeffrey Hill alleged that ACV Auctions, ACV Capital LLC, and ACV Transportation LLC posted job openings in Washington without disclosing this required pay and benefits information, leaving applicants without the wage transparency the law is designed to provide. The lawsuit covers all remote and Washington-based postings during the class period where this disclosure was missing.
ACV denies the allegations and denies any wrongdoing or liability. The parties agreed to settle to avoid the cost, uncertainty, and time of continued litigation. The settlement resolves claims against ACV Auctions Inc., ACV Capital LLC, and ACV Transportation LLC.

1. Confirm you are eligible
You must have applied for a Washington State job with ACV Auctions Inc., ACV Capital LLC, or ACV Transportation LLC between January 1, 2023, and July 26, 2025. No documentation is required.

2. Locate your Unique ID and PIN
ACV's records were used to identify class members. Check your email or mail for a notice containing a Unique ID and PIN. If you did not receive one but believe you qualify, contact the Settlement Administrator to verify your eligibility.

3. File online or by mail
Submit the Claim Form online at EPOASettlementACVACT.com/form/claim by June 29, 2026, or mail a paper Claim Form (postmarked by June 29, 2026) to: Hill v. ACV Auctions Inc., et al., c/o Simpluris, Inc., P.O. Box 26170, Santa Ana, CA 92799.

4. Receive your payment
Payments are issued after the Court grants final approval at the August 7, 2026 Fairness Hearing and any appeals are resolved. Payments will be characterized as non-wage damages and reported on a 1099.

Where the money is going
The settlement fund ranges from $1,770,748.20 to $2,700,000.00 depending on how many class members submit valid claims. All eligible claimants who file timely claims receive an equal share of the net fund after attorneys' fees, the service award, and administration costs are deducted.
The per-claimant amount is an equal share of the net fund divided by the number of valid claims filed. The estimated payment of $1,722.43 or more is based on current projections and may increase if fewer claims are filed. All amounts are subject to final court approval at the August 7, 2026 Fairness Hearing.

How much money will I receive?
Every class member who files a valid, timely claim receives an equal share of the net settlement fund. The total fund ranges from approximately $1.77 million to $2.7 million depending on how many people submit claims. After attorneys' fees ($796,500), costs ($5,000), and the class representative's service award (up to $20,000) are deducted, the remainder is divided equally among all claimants. The estimated payment is at least $1,722.43 per person, and may be higher if fewer claims are filed. Your estimated amount was included on the Claim Form mailed with your Notice.
Do I need to submit proof of purchase?
No documentation is required. You only need the Unique ID and PIN from the notice you received. If you did not receive a notice but believe you qualify, contact Simpluris at (833) 386-6511 to verify eligibility.
What if I didn’t receive a notice?
You may still file a claim if you did not receive a mailed notice. Contact the Settlement Administrator at (833) 386-6511 or Info@EPOASettlementACVACT.com to confirm your eligibility and obtain your Unique ID and PIN.
Does staying in the class affect my right to sue later?
By staying in the class and receiving payment, you release ACV Auctions Inc., ACV Capital LLC, and ACV Transportation LLC from all claims related to Washington wage disclosure violations during the class period (January 1, 2023 through July 26, 2025). To preserve your right to sue ACV on your own, you must opt out by June 29, 2026.
When will payments be sent out?
Payments are mailed after the Court grants final approval at the August 7, 2026 Fairness Hearing and after any appeals are resolved. The appeal period can take several months to over a year. Checks will expire 180 days after issuance.
