What happened
This lawsuit, Kubacki v. Antigo Construction, Inc., claims that Antigo Construction, Inc., Badger State Highway Equipment, Inc., Antigo International Inc., and Antigo MHB Breakers Ltd failed to adequately protect personal information on their network. Antigo discovered on June 6, 2025 that an unauthorized party had accessed its network between June 1 and June 6, 2025. Information potentially involved includes full names, Social Security numbers, driver's license numbers, financial account numbers, and health insurance information. The case is pending in the Wisconsin Circuit Court for Langlade County, and the Class Representative is Melvin R. Kubacki.
Antigo denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle the case to avoid the costs, risks, and uncertainty of continued litigation.

Where the money is going
The notice does not state a total settlement fund. It sets an aggregate cap of $200,000 on payments for documented out-of-pocket losses and lost time. If valid claims in those categories exceed $200,000, those payments are reduced pro rata. The notice also provides a flat $100 Alternative Cash Payment and two years of credit monitoring. Class Counsel will request attorneys' fees and costs and a service award for the Class Representative, subject to Court approval.
All amounts above are subject to Court approval at the December 14, 2026 Final Fairness Hearing. The Court may award less than the amounts requested. The notice does not state whether fees, service awards, and administration costs come out of the $200,000 cap or are paid separately.
Common questions
How much money will I receive?
You can claim either reimbursement of documented, unreimbursed losses and lost time (up to $3,000 combined, with lost time at $25 per hour for up to 5 hours) or a flat $100 Alternative Cash Payment. Loss and lost time payments may be reduced pro rata if valid claims exceed $200,000 in total. Two years of credit monitoring is available in addition to cash.
Do I need to submit proof of purchase?
The $100 Alternative Cash Payment requires no documentation. Documented loss claims require reasonable documentation of losses fairly traceable to the breach, and lost time claims require an attestation.
What if I didn’t receive a notice?
If you believe your information was involved in the June 2025 Antigo data breach but did not receive a notice, get more information from the settlement website directly at AntigoDataBreachSettlement.com or call the Settlement Administrator at 1-800-379-0170.
Does staying in the class affect my right to sue later?
Yes. Class Members who did not opt out by November 9, 2026 give up the right to sue Antigo and the other Released Persons over the Released Claims, whether or not they file a claim. The full release is in the Settlement Agreement, available on the settlement website.
When will payments be sent out?
The Court will hold the Final Fairness Hearing on December 14, 2026. Valid claims are paid within 45 days of the Effective Date, or within 30 days after approval, whichever is later. Appeals could delay payment.
