What happened

In September 2024, Electronics for Imaging, Inc., a printing technology company, experienced a targeted cyberattack on its computer systems. Files accessed may have contained names, addresses, phone numbers, dates of birth, photo IDs or driver's licenses, and Social Security numbers. This lawsuit, Hibbard, et al. v. Electronics for Imaging, Inc., claims EFI failed to adequately protect that information and is pending in the Merrimack County Superior Court in New Hampshire.

EFI denies wrongdoing, and the Court has not decided who is right. Both sides agreed to settle to avoid the costs and risks of trial.

You can claim up to $300 for ordinary documented expenses, up to $5,000 for documented identity theft or fraud losses, and up to $100 for lost time, or an alternative cash payment expected to be about $75. All cash payments may be reduced pro rata if claims exceed the $300,000 cap.

Do I need to submit proof of purchase?

Out-of-pocket loss claims require receipts or other documentation; self-made notes alone are not enough. Lost time claims (up to 4 hours) and the alternative cash payment do not require proof. Get more information from the settlement website directly at EFIDataSettlement.com.

What if I didn’t receive a notice?

The class includes all U.S. residents whose information was impacted, including those who got notice. If you think you were affected, get more information from the settlement website directly at EFIDataSettlement.com or call (833) 417-4923.

Does staying in the class affect my right to sue later?

Yes. Unless you exclude yourself by November 23, 2026, you give up the right to sue EFI over the claims released by the settlement, whether or not you file a claim. The released claims are described in Section X of the Settlement Agreement, available at EFIDataSettlement.com.

When will payments be sent out?

Payments are distributed only after final approval at the January 26, 2027 hearing and the resolution of any appeals. Check EFIDataSettlement.com for updates.
