What happened

The lawsuit alleges that Aramark, which operates food and beverage concessions at Capital One Arena in Washington, D.C., added a 3% "venue fee" to purchases without properly disclosing it, in violation of the D.C. Consumer Protection Procedures Act. The case covers purchases from Aramark at Capital One Arena on which the Venue Fee was charged from October 1, 2024 through December 31, 2025.

Aramark denies these allegations and any wrongdoing, fault, or liability, and the Court has not decided who is right. The parties agreed to settle to avoid the cost and uncertainty of continued litigation. The Superior Court of the District of Columbia has granted preliminary approval of the settlement, and a Final Approval Hearing is set for January 15, 2027.

How to file a claim

  • 1. Confirm you are eligible

You qualify if you made a purchase from Aramark at Capital One Arena and paid the 3% Venue Fee between October 1, 2024 and December 31, 2025. Settlement notices were sent by email in October 2026. If you are unsure, call the Settlement Administrator at (844) 659-2531.

  • 2. Estimate your payment

There is no fixed per-person amount. After the Court deducts administration costs (estimated at about $74,985), attorneys' fees and expenses, and any service award, each valid claimant receives a pro rata share of the remaining Net Settlement Fund. The more valid claims are filed, the smaller each payment will be, so no specific amount is guaranteed.

  • 3. File online or by mail

Submit your claim at the official claim form by December 4, 2026, or mail a paper Claim Form postmarked by that date to Venue Fee Settlement Administrator, PO Box 1268, Baton Rouge, LA 70821. The mail-in Claim Form, notices, and court documents are posted at VenueFeeSettlement.com. Have the claim ID from your email notice handy. If you did not receive a notice, contact the Administrator at (844) 659-2531 or info@VenueFeeSettlement.com.

  • 4. Receive your payment

You can choose to be paid by Venmo, PayPal, Zelle, direct deposit, or paper check. Payments are issued only if the Court grants final approval at the January 15, 2027 Final Approval Hearing and after any appeals are resolved. Any money left over after the claims process goes to the cy pres recipient, Public Justice.

Where the money is going

Aramark will pay $4,500,000 into a non-reversionary Settlement Fund. Court-approved administration costs, attorneys' fees and expenses, and the class representative's service award are paid from the fund first. The remaining Net Settlement Fund is divided pro rata among class members who submit valid claims. Money left over after the claims process goes to Public Justice as the cy pres recipient, and none of it returns to Aramark.

Total settlement fund (non-reversionary) $4,500,000
Attorneys' fees (requested, up to one-third) Up to $1,500,000
Litigation expenses (requested) To be set by Court
Service award (class representative) Up to $5,000
Notice & administration costs (estimated) About $74,985
Available for class members (estimated) About $2.92M before expenses

All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. The estimated amount available for class members is our own arithmetic and does not account for litigation expenses. Payments are made only if the Court grants final approval and after any appeals are resolved.

Common questions

How much money will I receive?

There is no fixed per-person amount. Each valid claimant receives a pro rata share of the Net Settlement Fund, which is the $4,500,000 fund minus Court-approved administration costs, attorneys' fees and expenses, and any service award. The final amount depends on how many valid claims are filed, so no specific payment is guaranteed.

Do I need to submit proof of purchase?

To be paid you must submit a timely, valid Claim Form by December 4, 2026. The Claim Form on the settlement website lists the information you need to provide, including the claim ID from your email notice if you received one. Check the Claim Form for any certification or other details it asks for.

What if I didn’t receive a notice?

If you made a purchase from Aramark at Capital One Arena and paid the Venue Fee between October 1, 2024 and December 31, 2025 but did not receive a notice, contact the Settlement Administrator at (844) 659-2531 or info@VenueFeeSettlement.com, or visit VenueFeeSettlement.com. A mail-in Claim Form is available on the Court Documents page and must be postmarked by December 4, 2026.

Does staying in the class affect my right to sue later?

If you stay in the settlement, you give up your right to sue Aramark and the other released parties over the issues resolved in this lawsuit, whether or not you file a claim. The full release terms are in the Settlement Agreement posted on the settlement website. To keep those rights, you must mail a written exclusion request postmarked by December 4, 2026.

When will payments be sent out?

Payments are issued only after the Court grants final approval at the January 15, 2027 hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
