Festival Fun Parks, LLC, the operator of the Raging Waters water parks, has agreed to an $850,000 settlement over allegations that ragingwaters.com engaged in drip pricing by adding a mandatory Processing Fee near the end of checkout that was not adequately disclosed up front, in violation of California's Unfair Competition Law. Anyone in the United States who bought admission tickets on www.ragingwaters.com between June 1, 2020 and June 22, 2026 and paid a Processing Fee can file a claim by November 24, 2026. Payments are a pro rata share of the net fund based on the total processing fees each claimant paid.

- No receipts are required to file. You attest under penalty of perjury that you bought tickets on ragingwaters.com during the class period and paid a Processing Fee.
- Excluded: Anyone who bought tickets only at the park gate or through a third-party seller rather than on www.ragingwaters.com, and anyone who timely opts out of the Settlement.

What happened
Plaintiff Andrea Velazquez filed this class action in Los Angeles County Superior Court alleging that Festival Fun Parks, LLC, which operates the Raging Waters water parks, violated California's Unfair Competition Law through drip pricing on www.ragingwaters.com. According to the complaint, the site advertised one ticket price and then added a mandatory Processing Fee near the end of the checkout process, so customers did not see the full price until they were about to pay. California law requires the advertised price to include all mandatory fees.
Festival Fun Parks denies the allegations and denies that it did anything wrong. The Court has not ruled in favor of either side. The parties agreed to settle to avoid the cost and uncertainty of continued litigation. Under the Settlement, Festival Fun Parks will pay $850,000 into a fund that, after Court-approved fees, costs, and administration expenses, will be distributed to claimants in proportion to the processing fees each of them paid during the class period.

1. Confirm you are eligible
You qualify if you live in the United States, bought admission tickets on www.ragingwaters.com between June 1, 2020 and June 22, 2026, and paid a Processing Fee at checkout. If the Administrator emailed you a notice, you have already been identified as a likely Class Member.

2. Understand how your payment is calculated
The $850,000 Settlement Fund, after deducting attorneys' fees (up to $283,333.33), litigation costs (up to $13,965.86), a service award to Ms. Velazquez (up to $2,500), and administration costs (up to $67,000), is divided among claimants in proportion to the total processing fees each claimant paid. Someone who bought tickets for a family every summer will receive more than someone who bought once. The notice does not estimate a per-person amount because it depends on how many people file.

3. File online or by mail
Submit your claim online at RagingWatersSettlement.com by November 24, 2026, or download the paper Claim Form and mail it (postmarked by November 24, 2026) to: Velazquez v. 4. Receive your payment
Payments are issued after the Court grants final approval at the November 9, 2026 hearing and any appeals are resolved. Because the claim deadline (November 24) falls after the hearing date, the Administrator will finish processing claims after the deadline before calculating and sending payments. No follow-up is needed once your claim is accepted.

The Final Approval Hearing is scheduled for November 9, 2026 at 9:00 a.m. Pacific in Department 6 of the Spring Street Courthouse, 312 N. Spring Street, Los Angeles, CA 90012. The date, time, or department may change without further notice, so check RagingWatersSettlement.com before attending. Note that the opt-out and objection deadline (September 28, 2026) comes before the claim deadline.
Where the money is going
This is a non-reversionary $850,000 common fund. Attorneys' fees, litigation costs, the service award, and administration costs all come out of the fund before claimant shares are calculated. Each approved claimant receives a share proportional to the processing fees they paid during the class period.
All amounts listed above are pending and subject to final court approval at the November 9, 2026 Final Approval Hearing. The Court may award less than the amounts requested. The estimated amount available to class members is Dapeer Law's arithmetic from the caps stated in the notice, not a figure from the notice itself.
Common questions
How much money will I receive?
It depends on how much you paid in processing fees and how many people file. The net fund (roughly $483,000 after the maximum fees, costs, and administration expenses) is split among claimants in proportion to the total processing fees each paid between June 1, 2020 and June 22, 2026. The notice does not estimate a per-person figure. Larger or more frequent ticket buyers receive proportionally larger shares.
Do I need to submit proof of purchase?
No receipts are required. The Claim Form asks you to attest under penalty of perjury that you purchased admission tickets on www.ragingwaters.com during the class period and paid a Processing Fee. Because payments are based on the fees you paid, the Administrator may use Festival Fun Parks' purchase records to determine your share, so use the same name and email address you used to buy tickets.
What if I didn’t receive a notice?
You may still be a Class Member. The Settlement covers everyone in the United States who bought tickets on ragingwaters.com during the class period and paid a Processing Fee, whether or not they received an email notice. File online at RagingWatersSettlement.com or mail a paper Claim Form to Velazquez v. Festival Fun Parks, Attn: Claim Forms, 1650 Arch Street, Suite 2210, Philadelphia, PA 19103 by November 24, 2026. Does staying in the class affect my right to sue later?
Yes. Unless you submit a request for exclusion by September 28, 2026, you will be bound by the Settlement and will release all claims that were alleged in the complaint or that arise from the same facts, whether or not you file a claim. That means you cannot separately sue Festival Fun Parks over the Processing Fee. The full release is in the Settlement Agreement on the Important Documents page.
When will payments be sent out?
Payments are expected after the Court grants final approval at the November 9, 2026 hearing, the November 24, 2026 claim deadline passes, and any appeals are resolved. If someone appeals, payment can be delayed a year or more. No further action is needed after you file; monitor RagingWatersSettlement.com for updates.
