What happened
This lawsuit, Hale, et al. v. ARcare, Inc., claims that ARcare failed to adequately protect patient information after unauthorized parties accessed its systems between January 18 and February 24, 2022. ARcare discovered the incident on or about February 24, 2022. The affected information may have included Social Security numbers, driver's license or state ID numbers, dates of birth, financial account information, medical treatment, prescription, and diagnosis information, and health insurance information. The case is pending in the United States District Court for the Eastern District of Arkansas.
ARcare denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle the case to avoid the costs, risks, and uncertainty of continued litigation. As part of the settlement, ARcare will also describe its post-incident security measures, which are paid for separately from the settlement fund.

Where the money is going
ARcare will pay $3,900,000 into a non-reversionary, all-cash settlement fund. Funds go first to medical data monitoring, then to Cash Payment A claims, then to Cash Payment B, and cash payments may be adjusted up or down on an equal percentage basis. Attorneys' fees, costs, service awards, and administration costs are paid from the fund.
All amounts above are maximums and subject to Court approval at the January 28, 2027 Final Approval Hearing. The Court may award less. Cash Payment B is estimated at $100 and may increase or decrease depending on the number of approved claims.
Common questions
How much money will I receive?
Cash Payment A reimburses up to $5,000 per class member for documented, unreimbursed losses more likely than not caused by the data incident. Cash Payment B is an estimated $100 payment, adjusted pro rata. You can also elect one year of medical data monitoring with $1,000,000 in identity theft insurance. Amounts are not guaranteed.
Do I need to submit proof of purchase?
Cash Payment A requires reasonable documentation of your losses; personal certifications alone are not sufficient. Cash Payment B does not require documentation of losses.
What if I didn’t receive a notice?

Does staying in the class affect my right to sue later?
Yes. Unless you exclude yourself by December 8, 2026, you will be bound by the settlement and release ARcare and the Released Parties from all Released Claims arising from or relating to the data incident, whether or not you file a claim. The full release is in the Settlement Agreement on the settlement website.
When will payments be sent out?
The Court will hold the Final Approval Hearing on January 28, 2027. Benefits are distributed after final approval and any appeals are resolved, which can take a year or more. Check the settlement website for updates.
