What happened
Plaintiff Sebastian Chaviano filed this class action in Miami-Dade County Circuit Court on July 6, 2026, alleging that Coast Dental Services, LLC, a Tampa-based dental services company, violated the TCPA's do-not-call rules (47 U.S.C. section 227(c) and 47 C.F.R. section 64.1200(d)) and the Florida Telephone Solicitation Act (Fla. Stat. section 501.059(5)). Mr. Chaviano says he replied "stop" to a Coast Dental visit reminder text on December 11, 2024 and received a confirmation that he was unsubscribed, but then received five more texts and two calls from Coast Dental between December 2024 and August 2025. The complaint alleges about 24,308 people received similar messages after opting out.
Coast Dental denies the allegations and denies any wrongdoing or liability, and the Court has not decided who is right. The parties signed a Settlement Agreement on August 25, 2026, and the Court entered an Agreed Order preliminarily approving the settlement on August 31, 2026. This is a claims-made settlement: Coast Dental will make up to $3,840,664 available, split into $1,434,172 for cash claims and $2,406,492 for voucher claims. Attorneys' fees and costs, the service award, and administration costs come out of that amount, and any money not claimed stays with Coast Dental.
How to file a claim
-
1. Confirm you are eligible
You qualify if, after replying "stop" or a similar opt-out to a Coast Dental text, you received more than one text or call on your cell phone within any 12-month period reminding you or encouraging you to schedule an appointment with Coast Dental, between April 14, 2021 and August 25, 2026. Notice was sent by email, with postcards mailed to class members without a working email address. If you are unsure, call 866-969-1557.
-
2. Choose cash or a voucher
On the Claim Form you choose either a pro rata share of up to $59 in cash or up to a $99 voucher that can be used only to buy an electronic toothbrush sold by Coast Dental. If you check neither box, or your choice is unclear, you will receive a voucher. Payments are calculated after attorneys' fees and costs, the service award, and administration costs are paid, so the final amount depends on how many people file and is not guaranteed. Only one claim is allowed per class member.
-
3. File online or by mail
File online at the official claim form by December 24, 2026 using the Claim Number and PIN from your email or postcard notice. You can also download the paper Claim Form and mail it, postmarked by December 24, 2026, to CDS TCPA Settlement, PO Box 2009, Chanhassen, MN 55317-2009, or email it to CDSTCPASettlement@noticeadministrator.com. The form asks for your name, address, the phone number that received the texts or calls, your current phone number, your cash or voucher choice, and a signed attestation. No phone records or ID are required. The notice and court documents are posted at CDSTCPASettlement.com.
-
4. Receive your payment
If the Court grants final approval at the December 9, 2026 Final Approval Hearing and any appeals are resolved, payments will be sent to the address on your Claim Form within 60 days after the settlement's Effective Date. Cash payments are made by check, and checks are valid for 90 days from the date printed on them. An appeal can delay payment by a year or more.

Where the money is going
This is a claims-made settlement, not a common fund that is fully paid out. Coast Dental will make up to $3,840,664 available, divided into a $1,434,172 pool for cash claims and a $2,406,492 pool for voucher claims. Attorneys' fees and costs, the service award, and notice and administration costs are paid from the Settlement Fund, and each claimant receives a pro rata share of what is available, up to $59 in cash or up to a $99 voucher. Money that is not claimed, including uncashed checks, remains with Coast Dental.
All amounts listed above are pending and subject to final court approval at the December 9, 2026 Final Approval Hearing. The Court may award less than the amounts requested. Because this is a claims-made settlement, the total actually paid depends on the number of valid claims, and unclaimed amounts remain with Coast Dental. Per-claimant amounts are maximums, not guarantees.
Common questions
How much money will I receive?
Each valid claimant can choose a pro rata share of up to $59 in cash or up to a $99 voucher toward an electronic toothbrush sold by Coast Dental. These are maximum amounts. Payments are calculated after attorneys' fees and costs ($430,000 requested), a service award of up to $7,500, and administration costs are paid from the up to $3,840,664 Settlement Fund, so the final amount is not guaranteed. Only one claim is allowed per class member, no matter how many texts or calls you received.
Do I need to submit proof of purchase?
You do not need phone records, screenshots, or ID. The Claim Form asks for your name, address, the phone number that received the texts or calls, your current phone number, your cash or voucher choice, and a signed statement that, to the best of your knowledge, you received more than one appointment text or call from Coast Dental after asking it to stop. The Settlement Administrator may verify claims. The online form uses the Claim Number and PIN from your notice.
What if I didn’t receive a notice?
If you believe you qualify but did not receive a notice, you can download the paper Claim Form and mail it to CDS TCPA Settlement, PO Box 2009, Chanhassen, MN 55317-2009, or email it to CDSTCPASettlement@noticeadministrator.com, by December 24, 2026. You can also call 866-969-1557 or visit CDSTCPASettlement.com to ask about your Claim Number and PIN.
Does staying in the class affect my right to sue later?
Yes. Unless you mailed a signed exclusion request postmarked by October 30, 2026, you will be bound by the settlement whether or not you file a claim. You give up the right to sue Coast Dental and the other Released Parties, including vendors and agents involved in sending the messages, over claims that arise out of or relate to calls or texts allegedly sent in violation of the TCPA or the Florida Telephone Solicitation Act. The full release is in the Settlement Agreement on the Important Case Documents page of CDSTCPASettlement.com.
When will payments be sent out?
Payments are sent only if the Court grants final approval at the December 9, 2026 hearing and after any appeals are resolved. Claimants will be paid at the address on their Claim Form within 60 days after the Effective Date. Cash checks are valid for 90 days from the date printed on the check. An appeal can add a year or more to that timeline.
