What happened

Plaintiff Hazem Arman filed this class action in DuPage County, Illinois against Al Piemonte Nissan (APN), alleging that the dealership violated the Telephone Consumer Protection Act by sending marketing text messages and making calls, more than once in a 12-month period, to residential telephone numbers that had been on the National Do Not Call Registry for at least 30 days. The class covers texts and calls made from May 9, 2021 through September 1, 2026.

Al Piemonte Nissan denies the allegations and denies any wrongdoing, and contends that it had an established business relationship with, or prior express written consent from, the people it contacted. The Court has not decided who is right. The parties agreed to settle to avoid the cost and uncertainty of continued litigation, and the Court granted preliminary approval on September 16, 2026.

Common questions

How much money will I receive?

Each Settlement Class Member who files a timely, valid claim can choose a $100 voucher redeemable for Al Piemonte Nissan products or services or a $20 cash payment. The amount is per person, regardless of how many texts or calls you received. If the fund is not enough to pay all claims, payments will be reduced pro rata, so no specific amount is guaranteed.

Do I need to submit proof of purchase?

You do not need to provide phone records. The online Claim Form uses the LoginID and PIN printed on the Notice sent to you. The Settlement Administrator may ask for more information to validate your claim, and claims that cannot be validated in time are invalid.

What if I didn’t receive a notice?

If you believe you received more than one text or call from Al Piemonte Nissan within a 12-month period between May 9, 2021 and September 1, 2026 on a number listed on the Do Not Call Registry, but did not receive a notice, email info@APNTCPASettlement.com with your full name and mailing address to request your LoginID and PIN, or call (866) 603-4665 to request a paper Claim Form. Mailed forms must be postmarked by December 15, 2026.

Does staying in the class affect my right to sue later?

If you stay in the settlement, you give up your right to sue Al Piemonte Nissan and the other Released Parties over TCPA and similar claims arising from texts or calls from APN during the class period, whether or not you file a claim. Released Claims and Released Parties are defined in the Settlement Agreement. To keep those rights, you must mail a signed exclusion request postmarked by December 15, 2026. Exclusions by phone, fax, or email are not accepted.

When will payments be sent out?

Payments are issued after the Court grants final approval at the January 6, 2027 hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
