Concord Hospital, Inc., Concord Hospital – Laconia, Concord Hospital – Franklin, and Capital Region Healthcare Corporation (collectively, Concord) agreed to an $800,000 class action settlement over allegations that third-party tracking technology, including website pixels such as Google Analytics and Geonetric, intercepted patients' telecommunications and disclosed their Protected Health Information without consent. Do you qualify?

You are a Class Member if ALL of the following apply:

  • You used a Concord Web Property (a website operated by Concord Hospital, Inc., Concord Hospital – Laconia, Concord Hospital – Franklin, or Capital Region Healthcare Corporation) between May 9, 2021, and June 12, 2026.
  • Your telecommunications may have been intercepted by Google and/or Geonetric, or your Protected Health Information may have been disclosed to Google, Geonetric, or other online tracking technology, while using a Concord Web Property.
  • Excluded: Concord Hospital, Inc., Concord Hospital – Laconia, Concord Hospital – Franklin, and Capital Region Healthcare Corporation and their officers, directors, agents, and affiliates; and the judge presiding over the case. What happened

The lawsuit alleges that Concord Hospital, Inc., Concord Hospital – Laconia, Concord Hospital – Franklin, and Capital Region Healthcare Corporation used third-party tracking technology, including website pixels such as Google Analytics and Geonetric, on Concord Web Properties. Plaintiffs allege this technology intercepted Settlement Class Members' telecommunications and disclosed their Protected Health Information to Google, Geonetric, or other online tracking vendors, in violation of the New Hampshire Wiretapping and Electronic Surveillance Act and the New Hampshire Patient Privacy Law.

Concord denies any wrongdoing and denies that it violated any laws. The Settlement does not decide who is right or wrong. It is a compromise to end the lawsuit and avoid the uncertainty and expense of continued litigation.

How to file a claim

  • 1. Confirm you are eligible

    You must have used a Concord Web Property between May 9, 2021, and June 12, 2026, during which your telecommunications may have been intercepted or your Protected Health Information may have been disclosed to online tracking technology.

  • 2. Review your claim

    Eligible Class Members share pro rata in the Net Settlement Fund. There is no fixed per-person amount; it depends on how many valid claims are filed against the $800,000 fund, after Court-approved deductions.

  • 3. File online or by mail

    Submit the Claim Form online at concordpixelsettlement.com/form/claim by September 11, 2026, or mail a paper Claim Form (postmarked by September 11, 2026) to: Branson v. Concord Hospital Inc. et al., c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799-9834.

  • 4. Receive your payment

    Payments are issued after the Court grants final approval at the November 3, 2026 Final Approval Hearing and any appeals are resolved. Payment is made by check unless you elect to receive payment electronically via the Settlement Website. No follow-up is required once your Claim Form is submitted.

The Final Approval Hearing is scheduled for November 3, 2026 at 9:00 a.m. ET at the Hillsborough Superior Court, 300 Chestnut St., Manchester, New Hampshire. The Court may postpone the hearing without further notice, so check ConcordPixelSettlement.com for updates before traveling.

Where the money is going

Attorneys' fees and expenses, service awards to the Class Representatives, and notice and administration costs are paid from the $800,000 Settlement Fund before payments to Class Members are calculated.

Common questions

How much money will I receive?

The amount in the Settlement Fund will be distributed to Settlement Class Members who submit a valid Claim Form on a pro rata basis, after deducting Court-approved attorneys' fees, litigation expenses, service awards for the Class Representatives, and notice and administration costs. The exact amount per person is not fixed in advance; it depends on how many valid claims are filed against the $800,000 fund.

Do I need to submit proof of purchase?

No documentation is required beyond a valid Claim Form. You do not need receipts or other proof of use; you confirm on the Claim Form that you meet the eligibility criteria.

What if I didn’t receive a notice?

You can still file a Claim Form if you did not receive a direct notice, so long as you meet the eligibility criteria (used a Concord Web Property between May 9, 2021, and June 12, 2026). Does staying in the class affect my right to sue later?

If you do not exclude yourself by September 11, 2026, you remain in the Settlement Classes and release your claims against Concord as described in the Settlement Agreement. To opt out, mail a signed letter with the case name and number, your full name and mailing address, a statement that you wish to be excluded, and your signature to: Branson v. Concord Hospital Inc. et al., c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799-9834, postmarked no later than September 11, 2026.

When will payments be sent out?

The Court will hold the Final Approval Hearing on November 3, 2026 at 9:00 a.m. ET at the Hillsborough Superior Court, 300 Chestnut St., Manchester, New Hampshire. If approved, it is estimated that Settlement Class Members will receive their payment within 90 days after final approval and any appeals are resolved.
