What happened
This lawsuit, Cadigan, et al. v. The Container Store, Inc., claims that The Container Store maintained point of sale devices in its Massachusetts stores that were not accessible to blind individuals, so blind customers could not independently credit purchases to their loyalty accounts. The plaintiffs brought claims under the Massachusetts Public Accommodations Act, the Equal Rights Act, and the Consumer Protection Law (G.L. c. 93A).
The Container Store disputes the allegations, and the settlement is not an admission of wrongdoing. In addition to cash payments, The Container Store agreed to install and use fully accessible kiosks in each store, train employees on them, and invite blind and visually impaired customers to use them.
How to file a claim
-
1. Confirm you are eligible
You must have had a vision-related disability requiring assistive technology and tried to credit a purchase at a Massachusetts Container Store to a loyalty account between July 20, 2011 and August 12, 2026, but encountered a kiosk without non-visual input.
-
2. Count your qualifying purchases
Each qualifying purchase is worth $75. Payments come from a $230,000 Damages Fund that also covers administration costs, so amounts may be reduced pro rata depending on the number of valid claims.

Where the money is going
The total settlement is $780,000. According to the settlement website, $230,000 of that is a Damages Fund used to pay valid claims and administration costs. The rest covers Class Counsel's attorneys' fees and costs and incentive awards to the two lead plaintiffs, subject to Court approval. The Notice does not say what happens to unclaimed money.
All amounts above are maximums and subject to Court approval. The available amount is our own estimate. Each qualifying purchase is worth $75, subject to pro rata reduction if valid claims exceed the Damages Fund.
Common questions
How much money will I receive?
Each qualifying purchase is worth $75, paid from a $230,000 Damages Fund that also covers administration costs. If valid claims exceed the fund, payments are reduced pro rata, so the final amount is not guaranteed.
Do I need to submit proof of purchase?
The Notice lists the eligibility requirements but does not describe what documentation, if any, must be submitted. Get more information from the settlement website directly at TCSSettlement.com or call 1-888-716-1143.
What if I didn’t receive a notice?
You can still file a claim if you meet the class definition. Get more information from the settlement website directly at TCSSettlement.com or contact CPT Group at 1-888-716-1143 or TCSSettlement@cptgroup.com.
Does staying in the class affect my right to sue later?
Yes. Class Members who do not exclude themselves release claims related to the accessibility of point of sale devices under G.L. c. 272, sec. 98, G.L. c. 93, sec. 103, and G.L. c. 93A, sec. 9, to the extent allowed by law.
When will payments be sent out?
Payments are made after the Court grants final approval and any appeals are resolved. The Notice does not give a payment date. Check TCSSettlement.com for updates.
