What happened
This lawsuit, Haney v. Costa Del Mar, Inc., alleges that Costa promised on its sunglasses packaging to repair damaged sunglasses for a "nominal fee," but charged Florida customers more than a nominal fee and did not disclose those charges, in violation of the Florida Deceptive and Unfair Trade Practices Act and the federal Magnuson-Moss Warranty Act. The case is pending in the Circuit Court for Duval County, Florida, and the Class Representative is Brendan Haney.
Costa denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle the case to avoid the costs, risks, and uncertainties of continued litigation.
How to file a claim
-
1. Confirm which class you are in
Purchase Class members bought non-prescription, non-promotional Costa sunglasses as Florida citizens between July 28, 2013 and January 31, 2018. Repair Class members paid Costa a component replacement fee between July 28, 2012 and January 26, 2025 for sunglasses bought on or before January 31, 2018. You can be in both.
-
2. Know what you need
Repair Class members do not need to file a claim and are paid automatically for each eligible repair that cost more than $11.95, based on Costa's records. Purchase Class members must file a claim; up to five purchases can be claimed without documentation, and claims for more than five may require proof.

Where the money is going
Costa will pay $21,750,000 into a common settlement fund. $6,375,000 is set aside for the Purchase Class and paid pro rata per qualifying purchase claimed. The remainder, after attorneys' fees and expenses and administration costs, goes to the Repair Class and is paid pro rata per eligible repair over $11.95. If at least $150,000 is left from uncashed payments, a second distribution may be made; any final remainder goes to Captains for Clean Water as cy pres, subject to Court approval.
All amounts above are subject to final Court approval at the March 23, 2027 Final Approval Hearing. The Court may award less than the amounts requested. The Repair Class estimate is our arithmetic and does not reflect administration costs or any Class Representative service award, which were not disclosed in the materials reviewed.
Common questions
How much money will I receive?
Payments are pro rata, so exact amounts are not known yet. Purchase Class members share $6,375,000 based on the number of qualifying purchases claimed. Repair Class members receive an equal share of the remaining net fund for each eligible repair that cost more than $11.95.
Do I need to submit proof of purchase?
Repair Class members do not need to submit anything; payments are based on Costa's records. Purchase Class members can claim up to five purchases without documentation, and claims for more than five purchases may require supporting documentation.
What if I didn’t receive a notice?
You may still qualify if you meet a class definition. Get claim instructions and more information from the settlement website directly at CostaSunglassLitigation.com, or contact the Settlement Administrator at 1-833-558-0945 or info@CostaSunglassLitigation.com. Repair Class members who moved should update their address in writing with the Settlement Administrator.
Does staying in the class affect my right to sue later?
Yes. Unless you exclude yourself by mailing a signed written request postmarked by January 19, 2027 to the Settlement Administrator, you will be bound by the Settlement and give up the right to sue Costa and the other Released Parties over the Released Claims. The full release is in Section 9 of the Settlement Agreement.
When will payments be sent out?
The Court will hold the Final Approval Hearing on March 23, 2027. Payments will only be issued after the Court grants final approval and any appeals are resolved, which can take a year or more. Check CostaSunglassLitigation.com for updates.
