What happened
Plaintiffs Jason Cumor and Sydney Dunn filed this class action against European Wax Center, Inc. alleging that the company disclosed information about visitors to its website, www.waxcenter.com, to third parties via pixels, cookies, code, and tracking or analytics tools without permission. The complaint asserts claims under the federal Electronic Communications Privacy Act (18 U.S.C. § 2511, et seq.), the Florida Security of Communications Act (Fla. Stat. § 934.03, et seq.), the California Invasion of Privacy Act (Cal. Penal Code § 631), and for invasion of privacy. The case is pending before the Honorable Melissa Polo in the Circuit Court for the 13th Judicial Circuit, Hillsborough County, Florida.
European Wax Center denies any wrongdoing and denies that it violated any law. The parties agreed to settle to avoid the cost, disruption to business operations, and uncertainty associated with continuing the litigation, and the Court has not decided who is right. Under the Settlement, European Wax Center will establish a Settlement Fund of up to $5 million to pay valid claims, notice and administration costs, attorneys' fees and expenses, and Service Awards to the Class Representatives.

Each Settlement Class Member who submits a valid Claim Form can receive a Cash Payment of up to $10.00. The Cash Payment may be reduced pro rata (an equal-share reduction) depending on the number of valid Claims filed and on what remains in the $5 million Settlement Fund after notice and administration expenses, attorneys' fees and costs, and Service Awards.

Receive your payment
Payments are issued after the Court grants final approval at the July 15, 2026 Final Approval Hearing and any appeals are resolved. The appeal process can take a year or more. No follow-up is required once your Claim Form is submitted.

Where the money is going
This is a Settlement Fund of up to $5 million. Notice and administration expenses, attorneys' fees and expenses, Service Awards to the Class Representatives, and Cash Payments to Settlement Class Members are all paid from this fund. If the total value of all approved Claims exceeds the funds available for distribution to Settlement Class Members, the Cash Payment will be reduced on a pro rata basis.
All amounts listed above are pending and subject to final court approval at the July 15, 2026 Final Approval Hearing. The Court may award less than the amounts requested. If the total value of all approved Claims exceeds the funds available for distribution to Settlement Class Members, the Cash Payment will be reduced on a pro rata basis, so actual payments may be less than $10.00 per claimant depending on claim volume.

How much money will I receive?
Each Settlement Class Member who submits a valid Claim Form can receive a Cash Payment of up to $10.00. The Cash Payment is paid from the up-to-$5 million Settlement Fund after notice and administration expenses, attorneys' fees and costs, and Service Awards to the Class Representatives. If the total value of all approved Claims exceeds the funds available for distribution, the Cash Payment will be reduced on a pro rata (equal-share) basis, so actual payments may be less than $10.00 depending on claim volume.
Do I need to submit proof of purchase?
The public Notice does not state that documentation is required to submit a Claim Form. Settlement Class Members are encouraged to submit claims online at EWCDigitalSettlement.com. Review the Claim Form for any verification fields. If you are not sure whether you are a Settlement Class Member, call the Settlement Administrator toll-free at (833) 447-6949.
What if I didn’t receive a notice?
Yes. You can still file a Claim Form even if you did not receive a direct notice, so long as you meet the eligibility requirements. Notice in this case was distributed primarily by publication and online, through the Settlement Website at EWCDigitalSettlement.com. If you are a U.S. resident who visited www.waxcenter.com between June 30, 2023 and April 2, 2026, you are likely a Settlement Class Member and can submit a Claim Form by June 30, 2026.
Does staying in the class affect my right to sue later?
Yes. Unless you exclude yourself by mailing a written, signed Request for Exclusion postmarked or received by June 30, 2026, you will be bound by the Settlement and you will release the legal claims at issue in this lawsuit against European Wax Center and the other Released Parties. That means you cannot separately sue European Wax Center for the Released Claims resolved by this Settlement.
