What happened

Plaintiff David Monk sued First Federal Bank of Kansas City in the Circuit Court of Jackson County, Missouri. The lawsuit alleges that the bank charged overdraft fees on debit card transactions that were authorized when the account had enough money but settled later when the balance was negative, and brings claims for breach of contract and breach of the implied covenant of good faith and fair dealing.

First Federal Bank of Kansas City denies any wrongdoing, and the Court has not decided who is right on the merits. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. The Court granted final approval on October 2, 2026, and any money remaining in the fund after distribution will go to Legal Aid of Western Missouri.
