What happened

The lawsuit alleges that Country Bank for Savings charged overdraft and NSF fees on items that had already incurred an NSF fee when they were re-presented for payment, and charged overdraft fees on transactions that did not actually overdraw the account.

Country Bank for Savings denies any wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. In addition to the $495,000 payment, the bank agreed to review and, if necessary, update its fee disclosures. The settlement fund also pays attorneys' fees, expenses, notice and administration costs, and service awards.

How to file a claim

  • 1. Confirm you are eligible

You are a Class Member if Country Bank for Savings' records show you were charged a Retry Fee or an Account Balance Fee between March 12, 2019 and December 31, 2025. If you are unsure, call the Settlement Administrator at (888) 808-8341.

  • 2. Estimate your payment

Each Class Member receives a pro rata share of the Net Settlement Fund, based on the Challenged Fees they paid compared with the total Challenged Fees paid by all Class Members. No one receives more than the fees they paid, and most people will receive less. An independent administrator calculates the amounts.

  • 3. Keep your address current

No claim form is required. Current accountholders receive an account credit, and former accountholders receive a check mailed to their address on file. If you have moved, call the Settlement Administrator at (888) 808-8341 or use the contact page to update your address. The notice, Settlement Agreement, and Court orders are posted on the settlement documents page, and updates appear at KimballFeesSettlement.com.

  • 4. Receive your credit or check

Under the Settlement Agreement, account credits are due within 21 days and checks within 35 days after the settlement's Effective Date, which follows final approval and the end of any appeals. Checks expire 120 days after they are sent.
