Gas Express, LLC d/b/a Circle K agreed to a benefits-based settlement over allegations that a May 2024 targeted cyberattack on Circle K's computer systems exposed files containing personal information such as names and Social Security numbers. U.S. residents who were sent a notice that their Private Information was impacted in the Data Incident can claim up to $2,000 in documented out-of-pocket losses (subject to a $45,000 group cap), or alternatively a one-time $50 cash payment (capped at the first 700 claimants), plus two years of CyEx Financial Shield Complete credit monitoring with $1 million in fraud insurance.

What happened

The lawsuit alleges that in May 2024, Gas Express, LLC d/b/a Circle K experienced a targeted cyberattack on its computer systems in which certain files containing Private Information, including names and Social Security numbers, were accessed. Brittany Canup, Quincy Brown, Clarrisa Johnson, and Kolonda Latrissa Smith filed suit on behalf of a putative class of U.S. residents whose Private Information was impacted, and the case was captioned Brittany Canup, et al. v. Gas Express, LLC d/b/a Circle K in the State Court of Fulton County, Georgia.

Circle K denies the allegations and denies any wrongdoing or liability, and the Court has not decided in favor of either side. The parties agreed to settle to avoid the costs, risks, disruptions, and uncertainties of continued litigation. The settlement does not establish a common fund; instead, Circle K separately pays approved claims (subject to per-benefit caps), two years of CyEx Financial Shield Complete credit monitoring with $1 million in fraud insurance for all enrolled Class Members, Court-approved attorneys' fees and costs, Service Awards, and notice and administration costs.

    Confirm you are eligible

    You must be a living U.S. resident who was sent a notice by Circle K that your Private Information was impacted in the May 2024 Data Incident. Most Class Members received a direct notice from Circle K (notification mailing was sent on or around May 6, 2026).     Choose your benefits

    All Class Members can enroll in two years of CyEx Financial Shield Complete credit monitoring with $1 million in fraud insurance. You can also claim one cash option: (A) reimbursement of up to $2,000 for actual, documented out-of-pocket losses incurred between May 20, 2024 and September 3, 2026 caused by the Data Incident, such as identity theft or fraud losses, credit report or credit freeze fees, ID replacement costs, and postage (subject to a $45,000 group cap on all Cash Payment A claims combined), or (B) a one-time $50 Alternate Cash payment with no proof required (capped at the first 700 Valid Claims, which is 10% of the Settlement Class). You may claim only one of Cash Payment A or Cash Payment B, not both. Cash Payment A requires supporting documentation (receipts, bank statements, etc.) and cannot cover losses already reimbursed by a third party.

    Submit the Claim Form online at gasexpressdatasettlement.com/form/claim by September 3, 2026, or mail a paper Claim Form (postmarked by September 3, 2026) to: Circle K Data Incident Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799. Required documentation must be submitted with the Claim Form for the Cash Payment A out-of-pocket reimbursement option.     Receive your payment

    Payments are issued after the Court grants final approval at the September 18, 2026 Final Approval Hearing and any appeals are resolved. The appeal process can take a year or more. No follow-up is required once your Claim Form and any supporting documentation are submitted.

Where the money is going

This Settlement does not establish a common fund. Instead, Circle K separately pays approved claims (subject to per-benefit caps), credit monitoring enrollments, Court-approved attorneys' fees and costs, Service Awards, and notice and administration costs. The amounts below show the per-benefit caps and the requested fees and awards.

All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. Cash Payment A is capped at $45,000 in aggregate; once the cap is reached, no further Cash Payment A claims will be accepted. Cash Payment B is capped at 700 Valid Claims (10% of the Settlement Class, approximately 7,000 members); once the cap is reached, no further Cash Payment B claims will be accepted. Attorneys' fees, Service Awards, and notice and administration costs are paid by Circle K separately and do not reduce the amounts available to Class Members.

Common questions

How much money will I receive?

Class Members can choose between two cash options. Cash Payment A reimburses up to $2,000 for actual, documented out-of-pocket losses caused by the Data Incident and incurred between May 20, 2024 and September 3, 2026, subject to a $45,000 group cap on all Cash Payment A claims combined. Cash Payment B is a one-time $50 Alternate Cash payment with no proof required, capped at the first 700 Valid Claims (10% of the Settlement Class). In addition, all Class Members can enroll in two years of CyEx Financial Shield Complete credit monitoring with $1 million in fraud insurance.

Do I need to submit proof of purchase?

Documentation is required for Cash Payment A (out-of-pocket reimbursement). You must submit proof such as receipts or bank statements showing how much you spent or lost as a result of the Data Incident. Personal certifications, declarations, or affidavits alone are not sufficient documentation, but may be included to clarify or support other reasonable documentation. You cannot claim expenses that have already been reimbursed by a third party. Cash Payment B (the $50 Alternate Cash) and the credit monitoring enrollment do not require any documentation of loss. What if I didn’t receive a notice?

The Settlement Class is defined as living U.S. residents who were sent a notice by Circle K that their Private Information was impacted in the Data Incident. If you did not receive a direct notice but believe you should have, contact the Settlement Administrator to confirm whether you are in Circle K's records. Does staying in the class affect my right to sue later?

Yes. Unless you opt out by submitting a written, personally signed Opt-Out Request postmarked by September 3, 2026, you will be bound by the Settlement and you will release the legal claims at issue against Circle K related to the May 2024 Data Incident. That means you cannot sue Circle K separately about the same incident. The full release language is in Section XI of the Settlement Agreement, available at GasExpressDataSettlement.com.

When will payments be sent out?

The Court will hold the Final Approval Hearing on September 18, 2026 in the State Court for Fulton County, Georgia at 185 Central Avenue, SW, Atlanta, GA 30303.
