What happened
This lawsuit, P.I.T. Retrievals, LLC v. HealthPort Technologies, LLC, claims that HealthPort, a medical records release company now known as Datavant LLC, charged patients and their designees more than the maximum fees allowed by the Pennsylvania Medical Records Act when they requested medical records from Pennsylvania providers for life and health insurance underwriting. The case has been pending in the Court of Common Pleas of Allegheny County since 2013.
HealthPort denies wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost and risk of further litigation. A separate case against Datavant, Landay v. Datavant Health LLC, involves different requests and has different deadlines.

This is a claims-made settlement with no fixed fund disclosed on the settlement website. Class Counsel's fees and costs and the service award are paid separately by HealthPort and do not reduce class member payments.

Common questions
How much money will I receive?

No receipts are needed. The Settlement Administrator uses HealthPort's records, but you must log in with your Class Member ID and submit a signed Proof of Claim through the settlement website.
What if I didn’t receive a notice?

Does staying in the class affect my right to sue later?
Yes. Unless you opt out so that your request is received by November 16, 2026, you cannot sue or continue suing HealthPort over the issues this case raised or could have raised. The exact released claims are in the Settlement Agreement on the settlement website.
