What happened
Bauer Built Inc. operates Bauer Built Tire & Service. Between April 16 and 21, 2023, a targeted cyberattack on Bauer Built's computer systems allegedly exposed full names, Social Security numbers, government ID numbers, driver's license and state ID numbers, and financial account numbers. Plaintiff Jordan Anderson filed this class action in the Circuit Court of Cook County, Illinois.
Bauer Built denies wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost and risk of continued litigation. Bauer Built pays settlement benefits, Class Counsel's fees, and the service award directly rather than from a common fund.

Where the money is going
There is no common fund. Bauer Built pays approved claims directly, including credit monitoring, documented loss reimbursements, and $45 cash payments. Class Counsel's attorneys' fees and the service award are also paid by Bauer Built and do not reduce class member benefits.
Fees and the service award are subject to Court approval at the January 27, 2027 Final Approval Hearing. The settlement website does not describe any aggregate cap or pro rata reduction. The $45 cash payment cannot be combined with Option 1 reimbursements.
Common questions
How much money will I receive?
It depends on the option you choose. Option 1 reimburses documented out-of-pocket expenses up to $500 (including lost time) and documented fraud losses up to $5,000. Option 2 is a one-time $45 cash payment. All claimants can also get two years of credit monitoring. Amounts are subject to Court approval.
Do I need to submit proof of purchase?
Not for the $45 cash payment or credit monitoring. Expense and fraud loss claims need documentation such as receipts or bank statements, and lost time requires a short description of what you did.
What if I didn’t receive a notice?
Class membership is based on Bauer Built's records of people sent notice. If you believe you were affected but did not receive a notice, get more information from the settlement website directly at BauerSecurityIncident.com or call (888) 226-9511.
Does staying in the class affect my right to sue later?
Yes. Unless you opt out by December 1, 2026, you cannot sue Bauer Built or join another lawsuit over the issues resolved by this settlement, whether or not you file a claim. The release is in paragraphs 65 to 67 of the Settlement Agreement.
When will payments be sent out?
The Final Approval Hearing is January 27, 2027. Payments are made after final approval and the resolution of any appeals. Check BauerSecurityIncident.com for updates.
