What happened

This lawsuit, In re: Kelly Benefits Data Breach Litigation, claims that Kelly & Associates Insurance Group, Inc., a benefits administration and insurance firm doing business as Kelly Benefits, failed to adequately protect private information that was compromised in a data breach between December 12 and 17, 2024. The case is pending in the United States District Court for the District of Maryland.

Kelly Benefits denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle the case to avoid the costs, risks, and uncertainty of continued litigation.

Common questions

How much money will I receive?

You can claim up to $5,000 for documented losses reasonably related to the breach, or an estimated $50 pro rata cash payment. California residents as of December 12, 2024 can also claim an estimated $100 California Statutory Payment. All class members can claim three years of credit monitoring. Final amounts depend on the number of valid claims.

Do I need to submit proof of purchase?

The pro rata cash payment and California Statutory Payment do not require documentation. Documented losses require supporting documents and an attestation under penalty of perjury; a personal certification alone is not enough.

What if I didn’t receive a notice?

If you believe your information was compromised in the breach but did not receive a notice, get more information from the settlement website directly at KellyBenefitsSettlement.com or call the Settlement Administrator at (833) 453-3640.

Does staying in the class affect my right to sue later?

Yes. Unless you exclude yourself by November 27, 2026, you will be bound by the Settlement and give up the right to sue Kelly Benefits and the Released Parties over the claims resolved in this case, whether or not you file a claim. The full release is in the Settlement Agreement, available at KellyBenefitsSettlement.com.

When will payments be sent out?

The Court will hold the Final Fairness Hearing on January 12, 2027. Payments are made only after the Court grants final approval and any appeals are resolved. Check KellyBenefitsSettlement.com for updates.
