CBIZ Data Breach Class Action Settlement

CBIZ Benefits & Insurance Services, Inc. agreed to a settlement of up to $485,000 over a 2024 data incident in which an unauthorized party accessed information maintained by CBIZ, including in some cases names and Social Security numbers. People who were mailed a notice about the incident can claim reimbursement of up to $5,000 in documented losses and a pro rata cash payment estimated at $100. What happened

The lawsuit concerns a 2024 data incident at CBIZ Benefits & Insurance Services, Inc. According to the settlement website, an unauthorized party accessed information maintained by CBIZ, including in some cases names and Social Security numbers. Plaintiffs allege that CBIZ failed to implement and maintain reasonable security measures.

CBIZ denies any wrongdoing and denies that it is or can be held liable, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. The settlement fund of up to $485,000 pays class member benefits as well as notice and administration expenses, any service awards, and attorneys' fees and litigation costs.

How to file a claim

  • 1. Confirm you are eligible

    You qualify if you were mailed a notice that your personal information may have been compromised in the CBIZ Data Incident. If you are unsure, call the Settlement Administrator at (866) 719-5560.

  • 2. Choose your benefits

    The settlement offers reimbursement of up to $5,000 for documented out-of-pocket losses, such as fraud losses, professional fees, credit freeze costs, and credit monitoring expenses incurred from 2024 onward, and a Pro Rata Cash Payment estimated at $100. The $100 estimate assumes a 10% claims rate among roughly 19,990 class members and will be adjusted based on the funds remaining after deductions.

  • 3. File online or by mail

    Submit your claim online at the official claim portal by December 24, 2026, or mail a paper Claim Form postmarked by that date to In re CBIZ Data Breach Litigation, c/o Simpluris, Inc., P.O. Box 25226, Santa Ana, CA 92799. The online form requires the LoginID and PIN printed on the front of your postcard notice. Documented loss claims require supporting documentation. The Settlement Agreement and notice are posted at CBIZDataBreachSettlement.com.

  • 4. Receive your benefits

    Payments are sent after the Court grants final approval at the January 13, 2027 Final Approval Hearing and any appeals are resolved. You can choose an electronic payment or a paper check; checks expire after 180 days.

The Final Approval Hearing is scheduled for January 13, 2027 at 9:00 a.m. ET at the Carl B. Stokes U.S. Courthouse, 801 West Superior Avenue, Cleveland, OH 44113. The Court will also consider Class Counsel's request for attorneys' fees, costs, and service awards, which are paid from the settlement fund. Opt-out requests and objections must be postmarked by November 24, 2026. The Court may move the hearing, so check CBIZDataBreachSettlement.com for updates before traveling.

Where the money is going

CBIZ will pay up to $485,000 into the settlement fund. The fund covers documented loss reimbursements and pro rata cash payments to class members who submit valid claims, plus notice and administration expenses, any service awards, and attorneys' fees and litigation costs. Because the cash payment is pro rata, the final amount per claimant depends on how many valid claims are filed.

All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. The $100 cash payment is an estimate based on an assumed 10% claims rate and may be adjusted pro rata based on the number of valid claims.

How much money will I receive?

You can claim reimbursement of up to $5,000 for documented out-of-pocket losses and a pro rata cash payment estimated at $100. The $100 figure assumes a 10% claims rate and is not guaranteed; it will be adjusted based on the number of valid claims and the funds remaining after deductions.

Do I need to submit proof of purchase?

Reimbursement of out-of-pocket losses requires documentation supporting the loss. The pro rata cash payment is not described as requiring documentation, but you still need to submit a valid Claim Form. The online form requires the LoginID and PIN from your postcard notice.

What if I didn’t receive a notice?

The class is limited to people who were mailed a notice about the Data Incident, and filing online requires the LoginID and PIN printed on that notice. If you think you should have received one, contact Simpluris at (866) 719-5560 or info@CBIZDataBreachSettlement.com before the December 24, 2026 deadline.

Does staying in the class affect my right to sue later?

If you stay in the settlement, you release all past, present, and future claims related to the Data Incident against CBIZ, whether or not you file a claim. To keep those rights, you must opt out with a request postmarked by November 24, 2026.

When will payments be sent out?

Payments are sent after the Court grants final approval at the January 13, 2027 Final Approval Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
