LexisNexis Risk Solutions FL Inc. agreed to a $13.5 million settlement over allegations that it reported consumers as deceased on identity verification and fraud prevention reports when they were alive. People whose LexisNexis FL report returned a deceased notation between August 11, 2017 and November 4, 2025 (Product Members), or who contacted LexisNexis FL about a deceased notation in that same period (Contact Members), can share equally in the fund. Product Members must file a Claim Form by May 15, 2026; Contact Members do not need to file anything to be paid.

Do you qualify?

You are a Class Member if ALL of the following apply:

  • Product Member (must file a Claim Form): an identity verification or fraud prevention transaction was run on you between August 11, 2017 and November 4, 2025, LexisNexis FL has a record that the transaction returned a deceased notation, LexisNexis FL’s system reflected a deceased notation associated with your identifying information that was received from the national credit reporting agencies, and you are not deceased.
  • Contact Member (no claim form required): you contacted LexisNexis FL between August 11, 2017 and November 4, 2025 to inquire about a deceased notation on a LexisNexis FL product, and LexisNexis FL has a record of the inquiry identifying it as related to or comparable to “deceased,” “death,” or “dead.”
  • There are approximately 1,700 Contact Members and 59,000 Product Members. The fund is divided equally among Contact Members and Product Members who file a valid Claim Form.
  • Excluded: LexisNexis FL and its officers, directors, agents, and affiliates; LexisNexis FL’s past and present employees; and the judge presiding over the case.

What happened

Plaintiff Kerry Jennifer Scroggins filed this class action against LexisNexis Risk Solutions FL Inc., alleging that the company reported her and other consumers as deceased on identity verification and fraud prevention reports when they were alive. The lawsuit claims those reports violated the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. The class period runs from August 11, 2017 through November 4, 2025 and covers two groups: people whose LexisNexis FL transaction returned a deceased notation (Product Members) and people who contacted LexisNexis FL about a deceased notation on a LexisNexis FL product (Contact Members).

LexisNexis FL denies any claim of wrongdoing and denies that its reports are governed by the FCRA. The parties agreed to settle to avoid the cost, risk, and time of continued litigation. The Settlement establishes a $13.5 million non-reversionary common fund. After attorneys’ fees and costs (capped at 33.33%), a service award to the Named Plaintiff (capped at $7,500), and notice and administration costs are deducted, the remaining funds are divided equally among each Contact Member and each Product Member who submits a valid Claim Form. Each Class Member will receive no less than $150 and could receive $1,000 or more, depending on how many Product Members claim.

How to file a claim

    Confirm you are eligible

    Product Members are people about whom an identity verification or fraud prevention transaction was run between August 11, 2017 and November 4, 2025 that returned a deceased notation tied to information from the national credit reporting agencies, and who are not deceased. Contact Members are people who contacted LexisNexis FL about a deceased notation on a LexisNexis FL product during the same period. Product Members must file a Claim Form to receive a payment; Contact Members will be paid automatically.

    Estimate your payment

    The $13.5 million fund is non-reversionary. After attorneys’ fees and costs (up to 33.33%, no more than $4,400,000), a service award (up to $7,500), and notice and administration costs are deducted, the remainder is divided equally among each Contact Member and each Product Member who files a valid Claim Form. Each Class Member receives no less than $150, with payments of $1,000 or more possible depending on the final claim count.

    File your Claim Form (Product Members only)

    If you are a Product Member, file your Claim Form online at deceasedreportsuit.com/claimform.aspx by May 15, 2026. You can also mail a paper Claim Form (postmarked by May 15, 2026) to: Scroggins v. LNRS FL, c/o Settlement Administrator, P.O. Box 16, West Point, PA 19486. The Claim Form requires you to truthfully affirm or swear that you are the person identified in the Notice and that you are alive. Contact Members do not need to file anything; payments are mailed automatically. To update your address, e-mail questions@deceasedreportsuit.com.

    Receive your payment

    Payments are issued after the Court grants final approval and any appeals are resolved. The Final Approval Hearing was held on March 16, 2026 at 11:00 a.m. ET in the Richmond Division of the U.S. District Court for the Eastern District of Virginia. Hannah Lauck at the United States District Court for the Eastern District of Virginia, Richmond Division, 701 E Broad St., Richmond, VA 23219. The opt-out, Reservation Request, and objection deadlines all closed on March 4, 2026. The Claim Form deadline for Product Members is May 15, 2026 and is subject to change; check DeceasedReportSuit.com for any updates.

Where the money is going

This is a non-reversionary common fund. Attorneys’ fees, the service award, and notice and administration costs come out of the $13.5 million before payments are calculated for Class Members. Whatever remains is divided equally among each Contact Member and each Product Member who files a valid Claim Form.

Common questions

How much money will I receive?

Each Class Member will receive no less than $150 and could receive $1,000 or more. The amount is the same for every Class Member: the fund (after fees, the service award, and administration costs) is divided equally among approximately 1,700 Contact Members and however many of the approximately 59,000 Product Members file a valid Claim Form. The fewer Product Members who claim, the larger each individual share.

Do I need to submit proof of purchase?

The Claim Form requires you to truthfully affirm or swear that you are the person identified in the Notice and that you are alive. The public Notice does not require additional documentation, but you should review the Claim Form at DeceasedReportSuit.com for any verification fields. Submitting false information on a Claim Form may carry legal consequences.

What if I didn’t receive a notice?

You can still file a claim if you did not receive a mailed notice, but you must be a Product Member as defined in the Notice. If you believe a LexisNexis FL identity verification or fraud prevention report incorrectly listed you as deceased between August 11, 2017 and November 4, 2025, contact the Settlement Administrator at 1-833-319-2038 or e-mail questions@deceasedreportsuit.com to confirm your status before filing. Direct mailed notice was the primary distribution method based on LexisNexis FL’s records.

Does staying in the class affect my right to sue later?

Yes. If you do not exclude yourself, you give up your right to sue LexisNexis FL and other Released Parties for any claim before the Effective Date based on the legal claims in this lawsuit and any claims under the Fair Credit Reporting Act or its state law equivalents. The exclusion deadline closed on March 4, 2026. If you submitted a Reservation Request by that deadline, you keep your right to bring a new individual lawsuit for actual or punitive damages under 15 U.S.C. § 1681i, while still receiving your settlement payment.

When will payments be sent out?

Payments will be issued after the Court grants final approval at the Final Approval Hearing (held March 16, 2026 in Richmond, VA) and any appeals are resolved. The appeal process can take a year or more. No follow-up is required once your Claim Form is submitted, just check DeceasedReportSuit.com for status updates.
