  • You are a current or former client of North Cottage Program, Inc. whose Private Information was involved in the cybersecurity incident that occurred on or around May 16, 2024.
  • You are included even if you did not receive a mailed notice of the Data Incident, as long as your information was affected.
  • Excluded: North Cottage Program, Inc.; the judges assigned to the case and their staff and family; and anyone found by a court to be criminally responsible for causing the Data Incident.

What happened

Robert Woodward and Timothy King filed a class action against North Cottage Program, Inc. after a cybersecurity incident occurred on or around May 16, 2024. Plaintiffs allege the incident exposed the personal information of North Cottage's current and former clients.

North Cottage denies the allegations and denies any wrongdoing or liability. The Court has not ruled on the merits of the claims. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation.

How to file a claim

  • 1. Confirm you're eligible

    You qualify if you're a current or former North Cottage client whose personal information was involved in the May 2024 data security incident, whether or not you received a mailed notice.

  • 2. Tally up your claim

    You can claim Credit Monitoring Services (one year of three-bureau monitoring plus $1 million in identity theft insurance) along with either (a) documented losses, up to $5,000 for extraordinary losses and up to $500 for ordinary losses or lost time, or (b) a flat $50 Alternative Cash Payment instead of documented losses. Total benefits are capped at $700,000, and cash payments may be reduced pro rata if valid claims exceed the available funds.

  • 3. File online or by mail

    Submit the Claim Form online at northcottagesettlement.com/submit-claim by August 28, 2026, or mail a paper Claim Form (postmarked by August 28, 2026) to: NOR Settlement, Attn: Claim Forms, 1650 Arch Street, Suite 2210, Philadelphia, PA 19103.

  • 4. Receive your payment

    Credit monitoring activation instructions and Cash Benefit payments go out after the Court grants final approval at the September 16, 2026 Fairness Hearing and any appeals are resolved. The appeal process can take a year or more. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for September 16, 2026 at 2:00 p.m. ET at Bristol County Superior Court, 441 County Street, Upper Courtroom, New Bedford, MA 02740. The Court may move the hearing, so check NorthCottageSettlement.com for updates before traveling.

Where the money is going

This is a claims-made settlement, not a fixed common fund. North Cottage will pay valid claims up to a $700,000 cap. Credit Monitoring Services are paid first; any remaining funds pay Cash Benefits, which may be reduced on a pro rata basis if total valid claims exceed what's left.

All amounts are pending and subject to final Court approval at the September 16, 2026 Fairness Hearing. The Court may award less than the amounts requested. Attorneys' fees, costs, and service awards are paid separately by North Cottage and do not reduce Settlement Benefits. If valid Cash Benefit claims exceed the funds remaining after Credit Monitoring claims, Cash Benefits will be reduced on a pro rata basis.

Common questions

How much money will I receive?

It depends on what you claim. Every eligible claimant can get one year of three-bureau credit monitoring plus $1 million in identity theft insurance, and either (a) up to $5,000 for documented extraordinary losses and up to $500 for documented ordinary losses (including up to 4 hours of lost time at $20/hour, no documentation required for lost time), or (b) a flat $50 Alternative Cash Payment instead of documented losses. Cash Benefits may be reduced pro rata if total valid claims exceed the $700,000 cap.

Do I need to submit proof of purchase?

Extraordinary Losses (up to $5,000) and Ordinary Losses (up to $500) require supporting documentation, such as receipts. Handwritten receipts alone are not enough on their own, though they can support other documentation. If you don't have documentation, you can still claim the $50 Alternative Cash Payment or Lost Time (up to 4 hours at $20/hour, no documentation required, just a signed attestation) instead.

What if I didn’t receive a notice?

Yes. The Settlement Class includes everyone whose personal information was involved in the May 2024 Data Incident, whether or not they received a mailed notice. If you're not sure you're included, contact the Settlement Administrator at 1-844-569-4296 or info@NorthCottageSettlement.com.

Does staying in the class affect my right to sue later?

If the settlement is approved, you give up the right to sue North Cottage or the other Released Parties over claims related to the Data Incident. The notice describes an objection process, not a separate right to exclude yourself from the settlement; if you disagree with its terms, your recourse is to file a written objection with the Court by July 29, 2026.

When will payments be sent out?

Credit monitoring activation instructions and Cash Benefit payments go out after the Court grants final approval at the September 16, 2026 Fairness Hearing and any appeal periods run, which can take a year or more.
