Do you qualify?
You are a Class Member if ALL of the following apply:
- McKenzie's records identify you as a Class Member, including anyone whose Private Information was potentially compromised in the April 2025 Data Incident or who was sent a notice about it.
- No proof is required to claim the $50 Alternative Cash Payment; documentation is only needed if you seek reimbursement of documented out-of-pocket losses up to $4,000.
- Excluded: McKenzie Memorial Hospital d/b/a McKenzie Health System and its officers, directors, and related companies; governmental entities; the judge presiding over the case and the judge's family and staff; and anyone who perpetrated the Data Incident.

What happened
In April 2025, McKenzie Memorial Hospital d/b/a McKenzie Health System experienced a targeted cyberattack on its computer systems. The lawsuit alleges that certain files containing private information were accessed, potentially including names, addresses, dates of birth, Social Security numbers, patient account numbers, medical record numbers, diagnosis and treatment information, contact information, and demographic information. The case, In Re: McKenzie Memorial Hospital d/b/a McKenzie Health System 2025 Data Breach Litigation, Case No. 2025-40999-CZ, is pending in the Circuit Court for Sanilac County, Michigan.
McKenzie denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle to avoid the costs, risks, disruptions, and uncertainties of continuing the litigation.
How to file a claim

1. Confirm you are eligible
You qualify if McKenzie's records identify you as potentially impacted by the April 2025 Data Incident, including anyone who received notice that their Private Information may have been compromised.

2. Choose your benefits
All Class Members can enroll in two years of CyEx Financial Shield Complete credit monitoring with $1 million in fraud insurance. You can also claim one cash option: (A) reimbursement of up to $4,000 for actual, documented out-of-pocket losses incurred between April 14, 2025 and August 24, 2026 and caused by the Data Incident, such as identity theft or fraud losses, credit report or monitoring fees, ID replacement costs, and postage, or (B) a one-time $50 Alternative Cash Payment with no proof required. You may claim only one of Cash Payment A or Cash Payment B, not both. Cash Payment A requires supporting documentation and cannot cover losses already reimbursed by a third party.

3. File online or by mail
Submit the Claim Form online at mckenziehealthsettlement.com/form/claim by August 24, 2026, or mail a paper Claim Form (postmarked by August 24, 2026) to: McKenzie Data Incident Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799.

4. Receive your payment
Payments are issued after the Court grants final approval at the October 6, 2026 Final Approval Hearing and any appeals are resolved. The appeal process can take a year or more. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for October 6, 2026 at 9:00 a.m. Eastern Time at the Circuit Court for Sanilac County, Michigan, 60 Sanilac Rd, Sandusky, MI 48471. The Court may move the hearing, so check McKenzieHealthSettlement.com for updates before traveling.
Where the money is going
This Settlement does not establish a common fund. Instead, McKenzie separately pays approved cash claims, two years of CyEx Financial Shield Complete credit monitoring for all enrolled Class Members, Court-approved attorneys' fees and costs, Service Awards, and notice and administration costs.
All amounts listed above are pending and subject to final court approval at the October 6, 2026 Final Approval Hearing. The Court may award less than the amounts requested. Attorneys' fees, Service Awards, and notice and administration costs are paid by McKenzie and do not reduce the cash payments or credit monitoring available to Class Members.
Common questions
How much money will I receive?
You can choose one of two cash options. Cash Payment A reimburses up to $4,000 for actual, documented out-of-pocket losses caused by the Data Incident and incurred between April 14, 2025 and August 24, 2026. Cash Payment B is a one-time $50 payment with no proof required. You may claim only one option, not both. All Class Members can also enroll in two years of CyEx Financial Shield Complete credit monitoring with $1 million in fraud insurance.
Do I need to submit proof of purchase?
Documentation is required only for Cash Payment A. You must submit proof, like receipts or bank statements, showing your losses. Personal notes alone are not enough, though they can support other documentation. You cannot claim expenses already reimbursed by a third party. Cash Payment B and credit monitoring enrollment require no documentation.
What if I didn’t receive a notice?
The Class is defined as all living persons in the United States whose Private Information was potentially compromised in the Data Incident, including those who were sent a notice from McKenzie. If you believe you are a Class Member but did not receive a notice, contact the Settlement Administrator to confirm your status before the claim deadline.
Does staying in the class affect my right to sue later?
Yes. Unless you exclude yourself (opt out) by August 24, 2026, you will remain in the Settlement and give up the right to sue, continue to sue, or be part of another lawsuit against McKenzie over the claims resolved by this Settlement. The full release is described in Section XI of the Settlement Agreement, available at McKenzieHealthSettlement.com.
When will payments be sent out?
The Court will hold the Final Approval Hearing on October 6, 2026 at 9:00 a.m. Eastern Time. Settlement payments are issued after the Court grants final approval and after any appeals are resolved. The appeal process can take a year or more. No action is required after a valid Claim Form is submitted.
