What happened
This lawsuit, Patel v. New York School of Interior Design, claims that NYSID failed to adequately protect personal information in a targeted cyberattack on its systems in November 2023. Information that may have been accessed includes Social Security numbers, driver's license or state ID numbers, passport numbers, financial account and payment card information, health insurance and medical information, taxpayer ID numbers, student ID numbers, and biometric information. The case is pending in the Supreme Court of the State of New York, New York County, and the named plaintiff is Priti Patel.
NYSID denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle the case to avoid the costs, risks, and uncertainty of continued litigation.

Where the money is going
The settlement website does not state a total settlement fund. NYSID will pay approved claims for documented losses, lost time, and the alternative cash payment, plus credit monitoring. NYSID will separately pay Class Counsel's attorneys' fees and costs and a service award for the Class Representative, subject to Court approval. The website does not describe any pro rata adjustment.
Fees, costs, and the service award are subject to Court approval at the January 27, 2027 Final Approval Hearing, and the Court may award less. Losses must have been incurred between November 2, 2023 and January 12, 2027 and not already reimbursed by a third party.
Common questions
How much money will I receive?
You can claim up to $500 in documented Ordinary Losses (including up to $100 for lost time) and up to $5,000 in documented Extraordinary Losses from identity theft or fraud, or instead choose a one-time $50 Alternative Cash Payment. Three years of credit monitoring is also available and can be combined with the $50 payment.
Do I need to submit proof of purchase?
The $50 Alternative Cash Payment requires no proof. Ordinary and Extraordinary Loss claims require documentation such as receipts, and Extraordinary Loss claims also require showing reasonable efforts to prevent or recover the loss.
What if I didn’t receive a notice?
If you believe your information was involved in the November 2023 NYSID Data Incident but did not receive a notice, get more information from the settlement website directly at NYSIDDataSettlement.com or call the Settlement Administrator at (833) 417-4986.
Does staying in the class affect my right to sue later?
Yes. Unless you exclude yourself by December 28, 2026, you give up the right to sue or join other lawsuits against NYSID over the claims this Settlement resolves, whether or not you file a claim. The released claims are in Paragraphs 68 through 71 of the Settlement Agreement.
When will payments be sent out?
The Court will hold the Final Approval Hearing on January 27, 2027. Payments are made only after final approval and any appeals are resolved. Check NYSIDDataSettlement.com for updates.
