Tuft & Needle, LLC, the direct-to-consumer mattress brand owned by Serta Simmons, has agreed to a settlement valued at approximately $2,995,000 over allegations that it deceptively advertised inflated reference prices and bogus discounts on mattresses sold through tuftandneedle.com to California consumers between January 1, 2020 and December 31, 2024. Class members get a Settlement Award equal to 45 percent of the discount Tuft & Needle represented they received on each mattress, either as a cash payment by claim or as an automatic website credit good for three years. The Parties estimate the average award is about $75 per mattress purchase across the approximately 40,147 covered mattresses. Class members who want cash, rather than the default website credit, must submit a Claim Form by July 14, 2026.

  • Excluded: Anyone who canceled or received a refund for each of their qualifying orders is not in the class.
  • Excluded: Class counsel and their firms; experts retained by the Parties; Tuft & Needle and its parents, affiliates, subsidiaries, and their officers and directors; the presiding judge and judicial staff; and anyone who previously signed a release with Tuft & Needle covering the same advertising or sales practices.

What happened

Plaintiff Emily Chebul filed this class action in the Superior Court of California for the County of San Diego, alleging that Tuft & Needle, LLC deceptively advertised various discounts on its direct-to-consumer mattresses sold through tuftandneedle.com. The complaint asserts violations of California consumer protection law together with claims for quasi-contract and unjust enrichment, breach of contract, breach of express warranty, intentional misrepresentation, and negligent misrepresentation. The theory is that the reference prices and percentage-off claims used to market the mattresses overstated the actual savings California shoppers received, in violation of California's False Advertising Law and related consumer statutes.

Tuft & Needle denies the allegations and denies any liability or wrongdoing. The Court did not decide who is right. The parties agreed to settle to avoid the cost, risk, and time of continued litigation. The Settlement provides class members with a Settlement Award equal to 45 percent of the discount Tuft & Needle represented they received on each qualifying mattress purchase, paid as cash to class members who submit a Claim Form or as a three-year website credit (the default) to those who do not. Tuft & Needle is paying notice and administration costs (estimated $48,000), attorneys' fees and expenses (up to $748,824), and a service award to Ms. Chebul (up to $5,000) separately, on top of the $2,995,000 in Settlement Awards, so the fees and costs do not reduce class compensation.

How to file a claim

    Confirm you are eligible

    You qualify if you purchased one or more mattresses on tuftandneedle.com while you were in California, between January 1, 2020 and December 31, 2024, and the mattress was advertised at a discount at the time of purchase. People who canceled or refunded every qualifying order are excluded. The Settlement Administrator is sending direct-mail or email notice to identified class members. If you receive a notice, you are a Settlement Class Member.

    Choose cash or website credit

    Your Settlement Award is 45 percent of the discount Tuft & Needle represented you received on each qualifying mattress. For example, if Tuft & Needle represented a combined discount of $100 across your qualifying purchases, your Settlement Award is $45. The Parties estimate the average award is about $75 per mattress. By default, you will automatically receive the award as a Website Credit usable for three years toward any purchase on tuftandneedle.com, with no blackout dates or minimum, that can be combined with other discounts and transferred to someone else. If you want cash instead, by check or electronic payment, you must submit a Claim Form by July 14, 2026.

    File online or by mail

    To elect the Cash Benefit, submit your Claim Form online at tnpricesettlement.com/submit-claim by July 14, 2026, or mail a paper Claim Form (postmarked by July 14, 2026) to: Tuft & Needle Settlement Administrator, P.O. Box 58220, Philadelphia, PA 19102. You only need to submit one Claim Form even if you purchased multiple qualifying mattresses, and you must attest under penalty of perjury that you were a California resident at the time of purchase. No proof of purchase is required to submit a claim.

    Receive your payment or credit

    Settlement Awards are distributed after the Court grants final approval at the July 10, 2026 Final Approval Hearing and any appeals are resolved. If anyone appeals, distribution can be delayed by a year or more. Website Credits are valid for three years from the date of final approval. No follow-up is required once your Claim Form is submitted (or if you take no action and accept the default Website Credit).

Where the money is going

This is a supplemental, claims-made settlement rather than a traditional common fund. Tuft & Needle is paying the class compensation, notice and administration costs, attorneys' fees and expenses, and the service award to the Class Representative as separate amounts. Fees and costs do not reduce class compensation. The total value of the Cash Benefits and Website Credits provided to the class is approximately $2,995,000.

The Court may award less than the amounts requested for fees, expenses, and the service award. Because fees and costs are paid by Tuft & Needle separately from the Settlement Awards, awards to class members are not reduced by the fee, expense, or service-award amounts.

Your specific amount depends on the total dollar amount of advertised discounts on your qualifying orders.

Do I need to submit proof of purchase?

No proof of purchase is required. Tuft & Needle and the Settlement Administrator have your purchase history from tuftandneedle.com. To receive cash, you submit a Claim Form attesting under penalty of perjury that you were a California resident at the time of purchase and that the information you provide is true and correct. If you do not submit a Claim Form, you will automatically receive the Website Credit by default.

What if I didn’t receive a notice?

Yes. You can still file a claim or accept the default Website Credit even if you did not receive a direct notice. If you purchased a discounted mattress on tuftandneedle.com while in California between January 1, 2020 and December 31, 2024, you may be a Settlement Class Member. Contact the Settlement Administrator at 1-855-699-4292 or visit TNPriceSettlement.com to confirm your status and submit a claim.

Does staying in the class affect my right to sue later?

Yes. Unless you mail a written request for exclusion postmarked by June 14, 2026, you will be bound by the Settlement and will release all federal and state law claims that arise from or relate to Tuft & Needle's advertising practices at issue in this case. This means you cannot separately sue or continue to sue Tuft & Needle on the released claims. Exclusion requests must be mailed to the Tuft & Needle Settlement Administrator, ATTN: Exclusion Request, P.O. Box 58220, Philadelphia, PA 19102.

When will payments be sent out?

If the Court grants final approval at the July 10, 2026 Final Approval Hearing, Cash Benefits will be issued and Website Credits will become available after the judgment becomes final and any appeals are resolved. Resolving appeals can take more than a year. Website Credits are valid for three years from the date of final approval. No follow-up is required once your Claim Form is submitted.
