What happened

Plaintiffs Larry Tran and Robert Cohen filed two consolidated class actions in Los Angeles County Superior Court alleging that Sprouts Farmers Market violated the Fair and Accurate Credit Transactions Act, 15 U.S.C. § 1681c(g), by printing more than the last five digits of customers' credit card, debit card, or EBT card numbers on electronically printed receipts. The trial court initially dismissed both complaints, the plaintiffs appealed, and the Court of Appeal remanded the cases to the trial court for settlement approval proceedings.

Sprouts denies the class action allegations and denies that it violated FACTA. The parties agreed to settle to avoid the uncertainty and cost of further legal proceedings, including the appeals. As part of the Settlement, Sprouts agreed to implement a written company policy that it will not print more than the last five digits of any credit, debit, or EBT card number, or any card expiration date, on receipts provided to customers.

Common questions

How much money will I receive?

There is no fixed per-claimant amount. Each valid claim receives a pro rata share of the Net Cash Fund, which is the $5 million fund minus Class Counsel's fees ($1,666,666.67) and litigation costs (up to $75,000), the $20,000 in service awards to the two Class Representatives, and notice and administration costs (up to $661,000), divided by the total number of valid claimants. Based on those caps, roughly $2.58 million is the estimated maximum available for distribution. Actual per-claim payments depend on how many people file. Each Class Member may receive only one share, regardless of how many qualifying transactions they had.

Do I need to submit proof of purchase?

It depends on which form you file. If you received an emailed Notice with a Notice Number starting with "P", Sprouts' records already show a qualifying transaction on your card, and you only need to submit the Short-Form Claim Form attesting that the card was yours. If you did not receive a P-Notice, you must submit Claim Form-R with proof: either a customer receipt showing more than the last five digits of your card number from a qualifying transaction, or a redacted credit, debit, or EBT card statement showing a qualifying Sprouts transaction. Statements may be redacted to hide account numbers and unrelated purchases.

What if I didn’t receive a notice?

Yes. Class Members who did not receive an emailed P-Notice can still submit a claim using Claim Form-R, but they must attach either a qualifying receipt or a card statement as proof. Notice was distributed by direct email to customers identified in Sprouts' records and by publication. If you used your personal credit, debit, or EBT card at a U.S. Sprouts store during the class period and still have a receipt or statement, you may be eligible. Visit SettleInfo.com or call the Settlement Administrator at 1-800-958-1026 for help.

Does staying in the class affect my right to sue later?

Yes. The deadlines to opt out of the Settlement or object to it both passed on April 7, 2026. Class Members who did not opt out by that date are now bound by the Settlement and release all claims that were alleged or could plausibly have been alleged in the Tran and Cohen actions based on the operative complaints, including claims under FACTA, the Fair Credit Reporting Act, and consumer-protection statutes, that arose during the class period from the electronic printing of card receipts. Class Members also waive California Civil Code § 1542 with respect to those released claims. The full release language is in the Notice and Settlement Agreement available at SettleInfo.com.

When will payments be sent out?

The Court will hold the Fairness Hearing on November 19, 2026 at 11:00 a.m. before Judge William F. Highberger in Department SS10 in Los Angeles. Payments will only be issued after the Court grants final approval and any appeals are resolved. The appeal process can take a year or more. After approval, each Eligible Settlement Class Member is mailed a check for their pro rata share, which expires 180 days from the issue date. Any uncashed funds are redistributed in a second round to first-round claimants who cashed their checks, with any remainder paid as cy pres to the Electronic Frontier Foundation.
