Vasindas' Around the Clock Care, Inc. agreed to settle a class action over a January 2024 cyberattack in which files containing private information were accessed. Class members can claim either a $70 cash payment with no documentation or reimbursement of up to $2,500 in documented out-of-pocket losses, and can also enroll in two years of medical identity monitoring. What happened

The lawsuit concerns a targeted cyberattack on Vasindas' Around the Clock Care, Inc. in January 2024, during which certain files containing private information were accessed. According to the settlement website, the information potentially involved includes names, addresses, Social Security numbers, and medical and health insurance information. The preliminary approval order describes the class as approximately 21,602 individuals.

Vasindas denies any wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. This is a claims-made settlement, so there is no fixed settlement fund. Vasindas will separately pay any attorneys' fees, litigation costs, and service awards the Court approves.

How to file a claim

  • 1. Confirm you are eligible

    You qualify if you are a living U.S. citizen who was sent notice that your Personal Information was actually or potentially accessed or compromised in the January 2024 Vasindas Data Incident. If you are unsure, call the Settlement Administrator at (866) 221-3058.

  • 2. Choose your benefits

    Choose one cash option: reimbursement of up to $2,500 for documented out-of-pocket losses incurred between January 30, 2024 and November 23, 2026, such as identity theft or fraud losses, credit monitoring fees, ID replacement costs, and postage, or an alternate $70 cash payment with no documentation required. All class members may also enroll in two years of CyEx Medical Shield Complete, which includes $1 million of medical identity theft insurance, using the enrollment code sent by postcard.

  • 3. File online or by mail

    Submit your Claim Form online at the official claim portal by November 23, 2026. The online form requires the LoginID and PIN printed on the Notice sent to you. You can also download a paper Claim Form and mail it, postmarked by November 23, 2026, to Vasindas Data Incident Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799. Documented loss claims require supporting documentation such as receipts or bank statements. Medical monitoring uses the enrollment code on your postcard; if you lost it, use the enrollment request form or contact the Administrator.

  • 4. Receive your benefits

    Payments are distributed and medical monitoring becomes active if the Court grants final approval at the December 3, 2026 Final Approval Hearing and after any appeals are resolved. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for Thursday, December 3, 2026 at 8:30 a.m. PT in Department T-2 of the Superior Court of California, County of Kern, 1415 Truxtun Avenue, Bakersfield, CA 93301. The Court will also consider Class Counsel's request for $260,000 in attorneys' fees and litigation costs and service awards of $2,500 for each Class Representative, which Vasindas will pay. Opt-out requests and objections are due by October 26, 2026. The Court may move the hearing, so check VasindasDataSettlement.com for updates before traveling.

Where the money is going

This is a claims-made settlement. There is no fixed settlement fund; Vasindas pays each valid claim directly, subject to the per-claimant limits below. Attorneys' fees, litigation costs, and service awards are paid by Vasindas and are not deducted from class member benefits.

All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. Documented loss reimbursements are paid only for valid, documented losses up to the $2,500 limit.

Common questions

How much money will I receive?

You can choose either an alternate cash payment of $70, which requires no documentation, or reimbursement of up to $2,500 for documented out-of-pocket losses incurred between January 30, 2024 and November 23, 2026. You cannot receive both cash options. All class members may also enroll in two years of CyEx Medical Shield Complete medical identity monitoring with $1 million of medical identity theft insurance.

Do I need to submit proof of purchase?

The $70 alternate cash payment does not require documentation. Claims for out-of-pocket losses of up to $2,500 require documentation such as receipts or bank statements. You still need to submit a valid Claim Form, and the online form requires the LoginID and PIN on your Notice.

What if I didn’t receive a notice?

The class is limited to people who were sent notice that their Personal Information was actually or potentially accessed or compromised in the Data Incident. The online claim form requires a LoginID and PIN from the Notice, and medical monitoring enrollment uses a code sent by postcard. If you lost your Notice, LoginID, PIN, or enrollment code, contact the Settlement Administrator at (866) 221-3058 or info@VasindasDataSettlement.com before the November 23, 2026 deadline.

Does staying in the class affect my right to sue later?

If you stay in the settlement, you give up the right to sue or be part of any other lawsuit against Vasindas over the legal claims resolved by this settlement, whether or not you file a claim. The full release is in Section VI of the Settlement Agreement. To keep those rights, you must opt out by October 26, 2026.

When will payments be sent out?

Payments are distributed and medical monitoring becomes active if the Court grants final approval at the December 3, 2026 Final Approval Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
