What happened
This lawsuit, Philip Durkin v. VNA of Texas, claims that VNA of Texas, a home health and hospice provider doing business as The Visiting Nurse Association of Texas, failed to protect personal information involved in a Data Incident on or around July 17, 2025. The case is pending in the 162nd Civil District Court of Dallas County, Texas, and the Class Representatives are Philip Durkin and Jacqueline Twinkle Harris.
VNA of Texas denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle to avoid the cost and risk of continued litigation. As part of the settlement, VNA of Texas will also fund information security enhancements separately from Class Member benefits.

Common questions
How much money will I receive?
You may choose either reimbursement of up to $4,000 for documented out-of-pocket losses, such as fraud losses, professional fees, credit freeze costs, and postage or mileage, or a flat $50 Alternative Cash Payment. The $50 payments are subject to a $165,000 total cap and may be reduced pro rata. All Class Members can also enroll in two years of three-bureau credit monitoring.
Do I need to submit proof of purchase?
The $50 Alternative Cash Payment requires only a valid claim form. Documented loss claims require third-party documentation such as receipts or bank statements. If a documented claim is deficient and not cured, it is paid as an Alternative Cash Payment instead.
What if I didn’t receive a notice?
If you believe your information was impacted in the July 2025 Data Incident but did not receive a notice, get more information from the settlement website directly at VNAofTexasDataSettlement.com or call 1-844-440-4349.
Does staying in the class affect my right to sue later?
Yes. Unless you exclude yourself by January 4, 2027, you release all claims arising from the Data Incident and VNA of Texas's information security practices, whether or not you file a claim. Opting out also forfeits the credit monitoring benefit.
When will payments be sent out?
Payments are made only after the Court grants final approval and any appeals are resolved. The Final Approval Hearing is March 8, 2027. Check VNAofTexasDataSettlement.com for updates.
