What happened

This lawsuit, Clarke, et al. v. Yuma Regional Medical Center, claims that YRMC failed to protect patient information in a cybersecurity incident the lawsuit says occurred April 21 to 25, 2022. The lawsuit alleges that names, Social Security numbers, health insurance information, and medical information of about 720,000 current and former patients were affected. The case is pending in the United States District Court for the District of Arizona.

YRMC denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle to avoid the cost and risk of continued litigation. YRMC has also committed more than $750,000 to data security enhancements, separate from the settlement fund.

Common questions

How much money will I receive?

You can choose Cash Payment A, reimbursement of up to $4,000 for documented losses such as identity theft or fraud losses, credit report, monitoring, or freeze fees, ID replacement, and postage. Or you can choose Cash Payment B, an equal share of the money remaining in the fund. All Class Members also automatically get one year of medical data monitoring.

Do I need to submit proof of purchase?

Cash Payment B requires no proof or explanation. Cash Payment A requires third-party proof such as bank statements or receipts tied to the Data Incident; self-made notes alone are not enough, and expenses already reimbursed by a third party are not eligible.

What if I didn’t receive a notice?

The Class is made up of people YRMC sent notice of the Data Incident. If you believe you are in the Class but did not receive a settlement notice, get more information from the settlement website directly at YumaSettlement.com or call 1-855-591-2021.

Does staying in the class affect my right to sue later?

Yes. Unless you exclude yourself by January 4, 2027, you cannot bring a separate lawsuit against YRMC about the issues covered by the settlement. The release is described in Section 13 of the Settlement Agreement.

When will payments be sent out?

Payments are made only after the Court grants final approval and any appeals are resolved. The Final Approval Hearing is March 1, 2027. Check YumaSettlement.com for updates.
