What happened
Plaintiffs Stacey Sears, Joel Aguilera, and Amber Smith filed this lawsuit against WellNow Urgent Care, P.C. on June 6, 2023 in the U.S. District Court for the Northern District of Illinois. They alleged violations of the Fair Labor Standards Act and the wage and hour laws of Illinois, New York, and Pennsylvania on behalf of hourly employees at corporate-owned WellNow locations.
WellNow denies all of the claims and any liability or wrongdoing, and the Court has not decided who is right. The parties reached the settlement after formal mediation to avoid the cost, risk, and delay of continued litigation. Unclaimed amounts that are not needed for fees and expenses will be returned to WellNow.
How to file a claim
-
1. Confirm you are a Class Member
The Settlement Administrator mailed notices on or around September 23, 2026. If you received a notice about Sears v. WellNow Urgent Care, P.C., you are likely a Class Member. If you are unsure, call the Settlement Administrator at (866) 610-9076.
-
2. Understand how your share is calculated
After Court-approved deductions, the Net Settlement Fund is divided using a points formula. Each Class Member is assigned points based on their work history, and each point is worth the same dollar amount. Payments are subject to applicable taxes and withholdings. Returning a Claim Form releases your Fair Labor Standards Act claims and certain state law claims.
-
3. Return your Claim Form by mail or email
Complete and sign the Claim Form mailed with your notice, or download the Claim Form, and return it postmarked or received by November 25, 2026. You can mail it to Sears et al. v. WellNow Urgent Care, P.C., c/o Simpluris, Inc., P.O. Box 26170, Santa Ana, CA 92799, or scan and email it to info@SearsWellNowSettlement.com. There is no online claim form. The Class Notice and Settlement Agreement are posted at SearsWellNowSettlement.com.
-
4. Receive your payment
Payments are mailed after the Court grants final approval at the December 16, 2026 Final Approval Hearing and any appeals are resolved. You must deposit your settlement check within 150 days after it is mailed.

Where the money is going
WellNow agreed to pay a total of up to $1,640,000 into a Gross Settlement Fund. Service payments, administration costs, and Court-approved attorneys' fees and costs are deducted first, and the remaining Net Settlement Fund is divided among Class Members and Opt-in Plaintiffs who return a Claim Form, using a points formula. Unclaimed amounts not needed for fees and expenses are returned to WellNow.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. The $574,000 figure is 35% of the Gross Settlement Fund, the maximum fee Class Counsel may request. Payments are subject to applicable taxes and withholdings.
Common questions
How much money will I receive?
Individual amounts are not fixed. After deductions, the Net Settlement Fund from the up to $1,640,000 Gross Settlement Fund is divided by a points formula based on each Class Member's work history. Payments are subject to applicable taxes and withholdings.
Do I need to submit proof of purchase?
No documentation is required. You only need to complete, sign, and return the Claim Form by November 25, 2026. Your eligibility and points come from WellNow's records.
What if I didn’t receive a notice?
Class Members were identified from WellNow's records and notices were mailed on or around September 23, 2026. If you think you qualify but did not get a notice, contact Simpluris at (866) 610-9076 or info@SearsWellNowSettlement.com before November 25, 2026.
Does staying in the class affect my right to sue later?
If you return a Claim Form, you release your Fair Labor Standards Act claims and certain state law claims. If you do nothing, you receive no payment but still release certain state law claims (not FLSA claims). Only a timely request for exclusion preserves your right to sue WellNow separately.
When will payments be sent out?
Payments come after the Court grants final approval at the December 16, 2026 Final Approval Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
