Albany College of Pharmacy and Health Sciences agreed to settle a class action over a 2024 cybersecurity incident that may have exposed names, Social Security numbers, financial information, and other personal data. Do you qualify?
You are a Class Member if ALL of the following apply:
- You live in the United States and your private information was potentially impacted in the ACPHS Data Security Incident that affected its computer systems between August 31, 2024 and September 14, 2024.
- Your notice includes the LoginID and PIN used to file a claim online.
- Excluded: Anyone who requests exclusion by the October 16, 2026 deadline.
- Excluded: ACPHS and entities it controls, the judges assigned to the case and their staff and immediate families, and anyone convicted of or pleading nolo contendere to a crime related to the Data Security Incident.

What happened
The lawsuit concerns unauthorized access to the network of Albany College of Pharmacy and Health Sciences between August 31, 2024 and September 14, 2024. According to the settlement notice, the information potentially affected includes names, Social Security numbers, financial information, passport and driver's license numbers, health insurance information, medical records, and student information. Plaintiffs allege that ACPHS failed to adequately protect that information.
ACPHS denies any wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. The settlement is administered on a claims-made basis with no aggregate cap on claims paid, and ACPHS separately pays administration costs, attorneys' fees and costs, and service awards, so those amounts do not reduce class member payments.

1. Confirm you are eligible
You qualify if you live in the United States and your private information was potentially impacted in the ACPHS Data Security Incident. About 26,411 people received direct notice of the incident. If you are unsure, call the Settlement Administrator at (833) 360-6834.

2. Choose your benefits
Every class member can claim two years of CyEx Financial Shield Total credit monitoring with $1 million in fraud insurance. You can also choose one cash option: reimbursement of up to $5,000 for documented out-of-pocket losses incurred between August 31, 2024 and November 16, 2026, such as identity theft losses, credit monitoring fees, ID replacement costs, and postage; up to $80 for lost time (up to 4 hours at $20 per hour); or an Alternative Cash Payment of $25 with no documentation required. You cannot claim both documented losses and lost time.

3. File online or by mail
Submit your claim online at the official claim portal by November 16, 2026, or mail a paper Claim Form postmarked by November 15, 2026 to ACPHS Data Security Incident Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799-9958. The online form requires the LoginID and PIN printed on your notice. Documented loss claims require supporting documentation. 4. Receive your benefits
Payments are distributed after the Court grants final approval at the December 10, 2026 Final Approval Hearing and any appeals are resolved. You can choose an electronic payment such as PayPal, Venmo, or Zelle, or a paper check; checks must be cashed within 60 days of issuance.

The Final Approval Hearing is scheduled for December 10, 2026 at 10:00 a.m. ET at the Supreme Court of Albany County, 16 Eagle Street, Albany, NY 12207. The Court will also consider Class Counsel's request for attorneys' fees, costs, and service awards, which ACPHS pays separately. Opt-out requests and objections are due by October 16, 2026. The Court may move the hearing, so check AlbanyCollegeSettlement.com for updates before attending.
Where the money is going
This is a claims-made settlement with no fixed common fund and no aggregate cap on the monetary amount of claims paid by ACPHS. Each valid claimant can receive two years of credit monitoring plus one cash option. Settlement administration costs, attorneys' fees and costs, and service awards are paid by ACPHS separately and do not reduce class member benefits.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. Claimants choose one cash option, and documented loss and lost time claims are paid only to the extent supported by the Claim Form and documentation.

How much money will I receive?
You can claim two years of credit monitoring plus one cash option: a $25 Alternative Cash Payment with no documentation, up to $80 for lost time, or reimbursement of up to $5,000 for documented out-of-pocket losses incurred between August 31, 2024 and November 16, 2026.
Do I need to submit proof of purchase?
The $25 Alternative Cash Payment does not require documentation. Documented loss reimbursement requires proof of the loss, and the Claim Form is signed under penalty of perjury. The online form requires the LoginID and PIN from your notice.
What if I didn’t receive a notice?
The class covers people whose information was potentially impacted in the Data Security Incident, and filing online requires the LoginID and PIN printed on the notice. If you think you should have received one, contact the Settlement Administrator at (833) 360-6834 or info@AlbanyCollegeSettlement.com before the November 16, 2026 deadline.
Does staying in the class affect my right to sue later?
If you stay in the settlement, you release all claims arising from the Data Security Incident against ACPHS and the other Released Parties, whether or not you file a claim. To keep those rights, you must opt out by October 16, 2026.
When will payments be sent out?
Payments are distributed after the Court grants final approval at the December 10, 2026 Final Approval Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
