What happened
The lawsuit concerns a September 2025 targeted cyberattack on the computer systems of Brevard Skin & Cancer Center, a Florida dermatology practice. According to the settlement notice, the information potentially affected includes names, dates of birth, home addresses, billing and claims information, Social Security numbers, diagnosis and clinical information, phone numbers, and email addresses. Plaintiffs allege that BSCC failed to adequately protect that information.
BSCC denies any wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. Benefits are paid on a per-claim basis, and BSCC separately pays notice and administration costs, attorneys' fees and costs, and service awards, so those amounts do not reduce class member payments.

1. Confirm you are eligible
You qualify if you live in the United States and were sent a notice by BSCC that your private information may have been impacted in the Data Incident. If you are unsure, call the Settlement Administrator at (833) 360-6880.

2. Choose your benefits
Every class member can claim one year of CyEx Medical Shield Complete medical data monitoring with $1 million in medical identity theft insurance. You can also choose one cash option: Cash Payment A reimburses up to $2,500 in documented out-of-pocket losses, such as identity theft losses, credit monitoring fees, ID replacement costs, and postage, incurred between September 28, 2025 and November 16, 2026. Cash Payment B is a one-time $45 payment with no documentation required.

3. File online or by mail
Submit your claim online at the official claim portal by November 16, 2026, or mail a paper Claim Form to BSCC Data Incident Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799-9958. The online form requires the LoginID and PIN printed on your notice. Cash Payment A claims require supporting documentation. 4. Receive your benefits
Payments are distributed after the Court grants final approval at the November 30, 2026 Final Approval Hearing and any appeals are resolved. Payment options reported for this settlement include PayPal, Venmo, Zelle, a virtual prepaid card, or a paper check.

The Final Approval Hearing is scheduled for November 30, 2026 at 9:00 a.m. ET at the Brevard County courthouse, 2825 Judge Fran Jamieson Way, Viera, FL 32940, or via Zoom at the Court's discretion. The Court will also consider Class Counsel's request for attorneys' fees, costs, and service awards, which BSCC pays separately. Opt-out requests and objections are due by November 2, 2026. The Court may move the hearing, so check BrevardSkinDataSettlement.com for updates before attending.
Where the money is going
This is a claims-made settlement with no fixed common fund. BSCC pays each valid claim directly: one year of medical data monitoring for every claimant, plus either a $45 cash payment or reimbursement of up to $2,500 in documented losses. Notice and administration costs, attorneys' fees and costs, and service awards are paid by BSCC separately and do not reduce class member benefits.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. Claimants choose either Cash Payment A or Cash Payment B, not both, and documented loss claims are paid only to the extent supported by documentation.
Common questions
How much money will I receive?
You can claim one year of medical data monitoring plus either a $45 cash payment with no documentation, or reimbursement of up to $2,500 for documented out-of-pocket losses incurred between September 28, 2025 and November 16, 2026. You must choose one of the two cash options.
Do I need to submit proof of purchase?
The $45 Cash Payment B does not require documentation. Cash Payment A for documented losses requires proof such as receipts or bank statements. You still need to submit a valid Claim Form, and the online form requires the LoginID and PIN from your notice.
What if I didn’t receive a notice?
The class is limited to people who were sent a notice by BSCC about the Data Incident, and filing online requires the LoginID and PIN printed on that notice. If you think you should have received one, contact the Settlement Administrator at (833) 360-6880 or info@BrevardSkinDataSettlement.com before the November 16, 2026 deadline.
Does staying in the class affect my right to sue later?
If you stay in the settlement, you give up the right to be part of any other lawsuit against BSCC about the issues this settlement covers, whether or not you file a claim. To keep those rights, you must opt out by November 2, 2026.
When will payments be sent out?
Payments are distributed after the Court grants final approval at the November 30, 2026 Final Approval Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
