What happened

Plaintiffs Laura Weitz and Laila Faiz sued Banana Republic, LLC and The Gap, Inc. in Los Angeles County Superior Court on behalf of non-exempt retail store employees in California. The lawsuit alleges failure to pay minimum and overtime wages, failure to provide compliant meal and rest periods and related premiums, failure to provide accurate itemized wage statements, failure to reimburse business expenses, failure to pay wages when due, failure to pay sick pay, and unfair competition. Plaintiffs also seek civil penalties under California's Private Attorneys General Act (PAGA).

Defendants strongly deny violating any laws or owing any wages, deny any liability, and say they complied with all applicable laws. The Court has not decided who is right, and the settlement is a compromise, not an admission of wrongdoing. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. Ms. Weitz also has a separate individual settlement with Banana Republic, LLC covering her own discrimination, retaliation, and wrongful termination claims.

Common questions

How much money will I receive?

Individual amounts are not fixed. The Net Settlement Amount, estimated at no less than $1,132,000, is divided by pay periods worked by all Participating Class Members, and Aggrieved Employees also share a $12,500 PAGA pool. Your notice lists the pay periods Defendants' records show for you.

Do I need to submit proof of purchase?

No. There is no claim form and no documentation is required. Payments are calculated from Defendants' records. The deadline to challenge your pay period count passed on July 21, 2026.

What if I didn’t receive a notice?

Class Members were identified from Defendants' records. If you worked as a non-exempt Banana Republic retail store employee in California from October 27, 2022 through July 4, 2025 and did not receive a notice, contact Atticus Administration at (800) 282-9601 or WeitzBRSettlement@atticusadmin.com to confirm your status and mailing address.

Does staying in the class affect my right to sue later?

Participating Class Members release wage and hour claims from the Class Period, including unpaid minimum and overtime wages, meal and rest break, wage statement, final pay, expense reimbursement, and sick pay claims. PAGA penalty claims are released for all Aggrieved Employees. Claims for vested benefits, FEHA, unemployment, disability, social security, and workers' compensation are not released.

When will payments be sent out?
